Default PPI-too late??

hi,Would like to know if PPI has same 6yrs limit as bank charges?Would love to reclaim on 2 loans-1 taken out in 98+the other in 2000.or is it too late?? thanx in advance for any advice shirl

Hello and welcome,

The limitation act is 6yrs and 6yrs for everything and they can agrue the toss and they probably will. There is some info about when you realise about the mis-selling on other threads It might be on the general debt threads I'm not too sure. Maybe read the statuatory library bit for homework on the limitation act and post a thread on the general debt forum.

I have approached a company for a loan in 2002, and they have refunded a ppi on a loan I had previous to this in 2000.

I do believe it is worth the cost of recorded delivery to try and reclaim the ppi.

If you don't try you will never know.

One more piece of advice. don 't believe a word they tell you they will resort of any tactic, but pay up.

Hi shirleyc, I'm in a similar position as I think I had been paying PPI on an MBNA credit card up until 2002 .

I'm reclaiming the penalty charges initially and noticed PPI payments on the statements until I cleared the balance with a transfer from another card in 2002. The PPI payments from Jan 01 to Feb 02 alone are over £400 ! I have been self-employed since 1996 and don't believe the PPI would have benefitted me whatsoever !

I would dearly like to know how much I paid in PPI prior to that but there appears to be no way to find out as it may be difficult to get statements going back more than 6 years !

Naturally, I hope I can get some idea as this could be a significant amount !

I seem to recall an old post from glennuk mentioning something about going back beyond six years which may be helpful (or otherwise !) - I'll try to find it and post a link (if I can work out how to post a link!)

Hi there Tim, I am also going the route of last 6 yrs charges 1st-only cos I cant seem to get info from NW prior to then!The nice man at the bank said I couldn't have any info longer than 6yrs ago cos they don't have to!Ihave now sent them Data Protection Act non-compliance letter because I want ALL info about loans,PPI,etc Data Protection Act-non-compliance-Template letters dont know if this is how you do links!! cheers Shirl

Hello Shirl,

When you send your letter, watch them come up with the info.

I am not an expert, but you have only now become aware of this mis-sellin of a ppi, because of their failure to inform you of the fact that they mis-lead you and have never actually disclosed this to you and did allow you to line their pockets with your money. The fraud act 2006.

Get your prelim letter sent and just see what they come up with. and certainly don't believe a word they say.

Well there is no harm in trying over the 6 year limit, You never know they may give in, but more likely they will put up a bit of a fight.

PPI Mis-Selling has really on came to light in the past year or so, Of course with the Publicity etc that has been generated over this in the past few months has no doubt had an effect on the amount of claims going in about it.

I would say nothing Ventured Nothing Gained..Have a Go and see what Bullsh*t they come back with.

I didn't think the Data Protection Act was time restricted ? I thought it was solely down to the (supposed) impracticability of recovering archived info from strange and unusual places ?!

Could be wrong, of course, someone able to clarify ?

btw. shirleyc -There seem to be a number of references to a Section 32 of the Limitation Act which apparently override the time barring aspect. I don't know if anyone has managed to come up with a cast-iron argument yet !

Hi Shirl, i;m also a Shirl and nearly freaked when i found your name on the forum as my surname also starts with a C and i often refer to myself exactly the way you do. ( and with the same icon)

i thought for a while that in a parra life i had found this site and been brave enough to post on the forum back in March!! your thread really threw me especially as i am going through the exact same now and have only today posted my first item. i do wonder how things turned out, with the limitation thing etc. any chance of an update, and or any advice you can give?

oh yeah, how did i work out in the end that your posting was not one i had posted earlier? you are with NW, im with LTSB and never held an account witih NW.

well i'm still plodding along 9 months after i started.Got 1st lot charges refunded-not much tho as most charges were pre-6yrs.
im fighting at the minute for PPI refunds but bit frustrating!!like banging your head on the wall!see my other thread for details.
anyway i wish you all luck and dont let the b**s grind you down!
