Default How can I prove it was misold?

I got a secured loan for £10000 back in 2000 with HFC and was sold insurance with it at a price of £38 over 3 years at an interest rate of 16.2%. But how can I prove that I was misold it. I know that I was persuaded that I needed to have the insurance to get the loan, but that was in a conversation. So what can I do?

I have just won with Lloyds, they told me at the time of the loan application that if I took the PPI the loan would be approved, classic case of mis selling. They are now about to pay me all my insurance money back, plus the interest. They have no record of what was said to you during your application, good luck, I will keep my fingers crossed for you!

Hello, I think just go for it. I am in the process of claiming back ppi's on 2 loans. I took the loans out over the telepone and ppi was not discussed I was actually unaware I had them till I sent the Subject Access Request. I know they will deny they were misold to me. But If I was aware that £4,660ppi and £1,400+ interest X 2 was optional, I really don't think I would have choosen to pay for it.

One company has sent me the credit agreement (no optional part of the ppi) and the other company can't find the agreement They have not sent me copies of any written correspondence from themselves to me. We are happy to lend you this money etc etc. They are not behind the door on this issue. So you have to do your homework and be prepared not to back down. I think they cringe when they hear my name.

We are all in the same boat. We can help each other and win back our hard-earned cash back that they tricked us into giving them.

I am trying to help my sister fight Barclays P.P.I, I have started a thread but so far no replies. Like 100% her husband was told no P.P.I no loan. She has corresponded with the bank and they say their final offer on this matter is a new loan for £11,500 @ 7.9% instead of 19.9% as offered earlier. This is a gesture of goodwill and in full and final settlement of your complaint.
I have read through the Policy document and it seems Barclays payout for nearly every thing on the P.P.I,ie Self employment, most illnesses etc, I find this very hard to swallow from Barclays as I was led to believe that the policies were vurtually useless. Anyway, apart from the P.P.i being made a condition of the loan, I am trying to say it was missold, because it says the policy will not pay out if "We have reason to believe that you are, or likely to become insolvent". Barclays gave them the loan to pay off a business loan that was in trouble, so they knew that the business was doing badly. The business has since closed.

Ok, my next problem though is I took the loan out 7 years ago, I phoned the branch of HFC this morning and they said they didn't have the documentation anymore. And the customer service department said more or less the same. Although I have it on the statements that HFC sent me that I was paying £355 per month and £38 appears to be for insurance. How do I fight it without the documents?

Oh and thanks for all the replies

Hi

Send your complaint of the basis of the things that you do have, and watch them come up with what you need.

Good luck
