Default lloyds tsb loan with ppi

In Feb 2002 I took out a loan for £29,000. The breakdown being, £10k cash, £14k to repay loan and overdraft, and £5k for PPI.
Started paying £626.60 per month in March 2002.
I took the loan out in my name as bank advised I had better credit rating, they also said that I would need PPI to get loan approved.
The monthly amount was paid through a joint a/c.
In Feb 2005 I left my husband and he stopped paying the loan. I knew nothing about it until Lloyds sent me a letter advising I had to pay late payment charges in full.
I paid them £2500 in October 05 but haven't paid them since.
I've made several offers to them as full and final settlements but they aren't accepting.
Now I've found this place and I think I should go down the route of them making me take on PPI.
Now do I send them a letter and if so, which one?
I'm new on here and have made myself dizzy reading 100s of posts, lol.
I did post on the Lloyds site as they are also chasing me for overdraft.
Well, I say chasing...they take over a month to answer every letter my debt councilor has sent to them.
I think I'll need to send a letter about the PPI and a separate one for my overdraft charges...but where do I start?
any help would be great

Hi gearbox welcome to the site! You've made the first step to reclaiming your charges by joining.

The most important bits to read are the FAQs and the template letters in the library. I would leave reading individual posts till later.

Reading your post it would seem that there are two separate issues; firstly the PPI and secondly late charges.

The second issue is the easiest to deal with and follows the well established route laid out on this site of S.A.R - (Subject Access Request), prelim letter, LBA and then issuing a claim either on line or in person, allocation questionnaire - bank caves in!

The second issue is harder as most of us are still feeling our way but read the posts by reidnet who took on Lloyds and won and who I think has the most experience. The real question with PPI is were you mis sold it? I think you have to prove that to get it back.

Thank you so much. I've read the FAQ's and had a look at the templates and I've decided I'm going to go ahead on both claims.
I will be using part of your letters...thanks for that...and when I've finished 'composing' I'll post on here before I send them.
I'm feeling a bit nervous as every time I've spoken to anyone at Lloyds collection centre they've made me feel like a scrounger...but reading about mis-selling of PPI I'm sure I've got some sort of chance.
They definitely made the PPI a point of me getting the loan and as I was self employed and already struggling with debts I accepted what they'd said just so I could get the loan.
The only thing I'm not sure on now is where to send the Subject Access Request..is it to Gresham Street in London?...and do I have to send the PPI one to County Durham...as I've only spoken to the collection centre at Brighton.

First of all NO ONE can sell you a loan and make you take PPI, it is against the law. They can advise it may useful but they cannot make you take it, and also they cannot say that it will increase your chances of having the application accepted, that is untrue. Lloyds TSB told me this themselves on Friday after I complained about my loan with them. I wrote to my branch and complained, it has now been passed onto head office. Sit tight and don't be bullied by them. They know they are in the wrong, it is only a matter of time until they realise they are not above the law. Good luck will be watching your thread

You only need to send the S.A.R - (Subject Access Request) if you don't have all the info you need to make the claim such as details of charges etc. If you have all you need go straight to the prelim stage!

Noticed this weekend that a couple of companies are trying to get in on the PPI mis-selling act...BEWARE...no win no fee just means that if you do win they take a very large chunk of your money...30%+

Lloyds TSB and PPI, now why does that make me laugh.. I had a claim against them for mis selling PPI, Basically no PPI no Loan.. I complained and then When I faxed my LBA, within 2 hours they were on the phone making an offer to settle..They tried a lower offer then Agreed to settle in full..as a gesture of goodwill, as I was considered a good Customer.. I bet they aint calling me that now..lol

Especially after today with round 2 of bank charges, they never submitted defence, So i hope the sheriff has granted the decree that I asked for..lol Then maybe have to send the Bailiffs in to local branch..

I was surprised that the sorted it out quick, that was certainly not the attitude they used when they were asked for comment from Granada TV for the Tonight With Trevor McDonald Programme.. Their comments were harsh and very defensive..lol. Just waiting now to see what they say to the letter of complaint I am sending regarding that Programme..lol

As for these No Win No Fee paracites..No Thank You..

It can be done but its a long haul. I took on LloydsTSB and got approx £4800 of PPI refunded on two policies and I am awaiting a decision on a third. Be prepared for a very long haul but if you stick in there you will win. My complaint took about a year to resolve after numerous letters to lots of different people. Eventually I went to the FSO who found in my favour quite quickly. Although the FSO gets a lot of bad press (you rarely hear about successful complaints) I found the whole process to be very efficient and fair.

My claim with Lloyds for the mis sold PPI went quickly and without any major problems. Maybe now that the Can of worms has been opened up they will fight these claims a bit harder.

Ohh well , the more publicity the issues of PPI can get all the better, I am already moving on with the Publicity stuff..lol.

I still have my Claim against GE Money / Purpleloans to get into court, hopefully very soon when the Information Commissioners Office respond with their decisions on my complaint against GE under the Data Protection Act.

Hi Ian,
one thing this site does is make you feel more confident.
Lloyds have been absolute baskets to me...very, very unhelpful and quite condescending.
Basically, because I owe them 10K on the loan and have an overdraft of 2 1/2k and no way to pay them they have made my life a misery.
I went to a debt councillor who did manage to get them off my back re phonecalls...they were phoning me at least once a day sometimes 3 times. They've also got two debt companies/solicitors or whatever they are...to hassle me too....very official looking letters...basically just telling me to pay up or else.
Since coming on this site I'm honestly not half as worried as I was...yes, I might still owe some money when thay take off the mis sold PPI and I might still owe some against my overdraft...but it's not going to amount to half of what they are saying I owe them.
I did make them several offers, which were refused...but now they can go whistle....when they sort out what they have overcharged me, I'll be happy to pay them the difference...if I've got it
I know in my position I could go bankrupt and was ready to take that route...but now I want to fight them and let them see that their bullying tactics won't work.
thanks to all who have helped and are helping me...even if it's just to give me confidence.
I love it when I see anyone winning a claim on here and I don't mind waiting for however long it takes for me to get there too
Ian, I hope your claim against GE money/purple loans gets the right result...fingers crossed

Hang on in there m8, whatever you do don't let the %4&&^^£s Get you down. I know from experience that it can be very frustrating dealing with this outfit and others. I know for fact I have myself sort of lost the will to carry on at times with my claim against GE, but hey that is just what they want me to do. And remember there are lots of others in the same situation on here and you will always find comfort and support here on CAG, I know I have on several occasions.

I believe that these companies have been getting away with daylight robbery for many years and now it is time for us Little People to stand up and say Enough is Enough.

I started off on a small mission with lloyds then moved on to the Bigger one with GE Money, I have spent many many hours researching and hunting the Net etc to gather as much Information as possible. What started as a small mission has turned into world war 3..lol

I also do as much as I can to raise the Issues of this PPI racket be it on here or in the Press. Im now working with a Media company that deal with all the National Newspapers, and at the momment I am in discussion with the media company and a big National newspaper who are looking at running some articles on PPI, and hopefully get a good few mentions for the CAG, sadly Granada TV did not use the part where CAG was mentioned.

Stick in there and if you need any help / support Just shout..

Thanks for the good luck re GE Money.. Hopefully if the Information Commissioners Office pull their finger out I hope to get this one finished off and Submitted to court very soon.
