Default EGG Card and PPI not signed for

Hello,

I am in the process of claiming a quite reasonable sum of money back from EGG credit card and included the PPI because I never signed for anything. I have received a response back with a screen print of my application back in june 2000 showing that I have chosen for PPI cover. Now they haven't shown me anything signed and I am just about to ask for signed credit agreements as they didn't come in my original data protection request.

If they have no SIGNED acceptance of this cover, do I have the right to claim it back? Could it have been one of those annoying tick boxes that needed to be unchecked or something?

Any advise would be really helpfull.

Hi Smackbat,
Just a couple of things.. If your agreement was set up over the telphone then you should also ask them under your S.A.R - (Subject Access Request) to include any transcripts and recordings of telephone calls.

If it was standard written application forms etc, then if they cannot provide a copy of the agreement with the PPI section completed and signed then I would say..You are within your rights to claim it back, plus interest of course.

If you have any probs just give me a shout.

Smackbat I am in exactly the same position. When you get your agreement you will find there is no mention of PPI but Eggs attitude is "you asked for it so there". Needlesly to say I dont agree and after having exhausted their complaints procedure,"we know you asked for it so there". I have now escalated the issue to the Financial Ombudsman. If that gets me nowhere then off to court I go. This seems to be a common thread with Egg that no one asks for PPI yet everyone seems to get it.

Thanks, and that is exactly what I was expecting them to say. They are bunch of %^£() @!!&@ !£@!! idiots!

I'll join that queue to the Financial Ombudsman office, however it appears that he is about aas much use as a chocolate teapot.
