I havn't and wont post all the letters etc regarding this one..lol It would take up far too much room. To say the least I have had an ongoing battle with mob. I had to keep some info underwraps on this one with the Daily Record article a wee while ago, and Just havnt really had the time to Update on here.
I sent my original complaint to them in Sepember and have been fighting with them ever since. I took Nighmare4banks advise on a good few things.lol and have now totally exhausted their internal complaints procedure. I esculated the complaint to their Customer Services Manager and now have agreed that we have reached a deadlock situation.
I think at this stage they are looking for me to roll over and go away..lol FRAID not.. Mind you having said that I felt like doing that a few weeks ago. But thanks to words from certain members around here , Im back Alive and ready to Kick Ass..lol
I have decided now Court is the only way forward, the papers are almost ready to go to court. I will also be using the English Court System as luckily their registered office that I initially contacted is based in Wolverhampton.
I will be issuing a claim via Wolverhampton Court, which is far better for me really as with the limitations of the small claims here in Scotland. Only bad thin I suppose if it does go to a hearing it means a 6 hour Drive for me from Dundee, but Im not going to give in until I get what is mine back from these muppets. Anyone in Wolverhampton got a spare sofa for the night ..lol ?
I wrote to the FOS - and that was a waste of a stamp..GE were not under the Jurisdiction of the FOS at the time of the sale.
The FSA were a bit better, at least they have passed my complaint onto the department that Monitors GE Money, although they will never tell you what the outcome of their Investigation is.
The FISA who did regulate GE Money at the time , have not even acknowledged my complaint, in fact I think I will go and try Phoneing them when I post this..
It has to be said what the Hell do the FOS, FSA and FISA actually do to help Consumers..as far as I can see its not very much.
I have also been involved in long dscussions with Granada media regarding the Tonight With Trevor McDonald program which is going out mid January next year..I hope at least this will alert other Consumers to the massive rip off market that is so called PPI by the likes of GE Money / Purpleloans and Firstplus.
I am also in discussion with another Media company regarding my story being used as a case study in the Mail on Sunday, so at least win or loose my claim I will hopefully have encouraged others not to sit back and take this sort of bad practise any longer.
I have also got rid of the Loan & PPI but intend to fight to the death to get my premium of £3388 plus interest back from them.
The loan company charged over £750 for early settlement..well some letters back and forth on that matter and I have since Lodged a claim to recover that charge through the Small Claims court.
Though I havnt been around here as often as I should have been , I have been keeping popping in and out when I can to see whats happening.

So this thread is about PPI from Purple loans and thier PPI stake on that. I had two loans with HBOS and at the aplication stage in the bank, the assistant manager said he wouldnt give me the loan to pay off o?d run up because of bank charges, unless I took out his insuarnce. I nevr in my life took one of those out, because I was in tenured position, with guatanteed position until 65. But he was not fro moving. So wrote off in June for statements, then Sept, but nothing doing. So from CAG site got an eamil address of an HBOS employee to who was to assist HBOS customers sort out thier positions. I have had numerous emails, phone messges etc. He was able to locate the numbers of the loans, but to daye none have appeared. Anyway here is message sent to me today.
Dear xxxx sorry about this, I have asked bbbbb one of my
colleagues to ensure that this information is obtained along with the
data that nnn is compiling. Although not actually at the sharp end
myself, I am finding the issues relating to your account a little
perplexing. So I guess I have a good idea how you feel. Please bear
with me a little longer as I do not take defeat well and am determined
to resolve this. Hopefully this will identify what the problems were
and ensure that we can ensure that they do not happen again.
Anyway if I am to chase my ERC in england, can i do this with scottish addrss and travel to english court. The erc in 2004 was for about 6000, so with interest even at 8% it will be a good bit more. I was aslo considering using an english based no win/no fee conpany for claims that I would not be able to claim for. eg the sixth year of bank charges at thier english head office.

What fees have they charged you, If they are unfair charges then Yes I would still make aclaim against them. After all you have nothing to loose..

If you have all the details of the settled account you should not really need to submit Subject Access Request.
I presume since solicitors fees were included the loan must have been a secured loan on his property ?. If this was the case then the fee charged for removal of the security would be a valid charge, that is if it was a reasonable amount of around £150.
The high figure that they charged you for early settlement Interest charge, If the loan was taken out before Feb 2005 they would have used a calculation under the Rule of 78 to calculate the ERC, This rule I did challenge when I settled my Loan with Firstplus (which was arranged through a GE Money Company). The claim I had against firstplus was due to be heard in court on 5th Feb, they said their legal eagles did not agree with my legal arguments and beleived them to be flawed..But as a gesture of Goodwill they wanted to settle the claim in full as long as I dismmised the case with the court. Now to me that is them running scared..lol If my legal arguements were so flawed, why not stand up in a court and prove that..lol.
If there is anything you are unsure about let me know..
And if you are writing to GE Money to complain, I will give you a contact name, address, fax and Phone Number..
You will find with GE Money though, they do not work to any timelines that you state, they seem to think they can do as they like.
I am Just waiting for the Outcome of my Complaint to the Information Commissioners Office regarding GE Money's Failure under the Data Protection Act (The Information Commissioners Office are Investigating this at the momment). Then I will be submitting my claim to court.
I would always deal with this lot by letter and never get into telephone discussions with them , unless you have the abillity to record any such conversations.

sorry for the brief hijack, but I need some fast advice
Claimed against RBS Visa for PPI under misselling -
I ticked the box, but -
Advised it would help my chance of approval
(credit agreement even states - "we strongly recommend you take this insurance)
No PPI agreement
No terms and conditions
No advice given or questions asked re suitability for me
No advice given on alternatives
Claim is in and they have defended, but it basically says we deny misselling, we want the claimant to prove all this
What can I do, or is the burden of proof on them to prove they have given me all of the above?  |
