Hi Sorry I'm Highjacking now. I am in a similiar situation as yourself. I was pressured to have the ppi. I was facing financial difficulties and they knew. I received no policy terms or conditions and was not informed as to what a ppi was. Nobody discussed why I would need it I thought ii was part of the loan. I didn't realise how much it was till I started looking. The two loan companies are not sending me info on the loans as I thinkd they dare not because they know what I am going to do. I know that they are going to deny that they mis-sold me the policy, so how do I prove it.

If they never sent you a copy of the PPI Policy, how do you know you actually have any cover. Did you send thema Subject Access Request or a CCA, if you did you should have recieved all the information you requested, in fact if the do not supply the information that they hold on you they are breaking the law.

If you sent them a Subject Access Request and it over 40 days since they recieved it they are commiting an offence by not supplying the information. If this is the case send them a Failure to Comply Notice under the data protection act and lodge a complaint with the Information Commissioners Office

The right to disclosure of data is provided by the Data Protection Act. There is no time limit. Some companies are saying that they do not have to disclose where it would be difficult to do so - "disproportionate effort". This is untrue. If you are seeking bank charges information then you should ask for "all data held on you" and you should make it clear that you want everything as far back as it goes. Do not be put off by excuses. Do not accept being fobbed off. It is not in your bank's interest to make full disclosure to you. This means that it is in your interests to get it. If you have not started gathering your bank charges information yet, then you should start now. There will soon be a big rush once the OFT test case has been settled. Get all of your bank account informtion as far back as possible. At least as far back as 1995. If your bank says that they don't keep data as far back as this, don't accept it. Be persistent. They've got what you need in some form or other.

Forgot to Mention... The Daily Record are doing a follow up to my last story on Thursday 8th March which is well and truley aimed directly at GE Money / Purpleloans. Funny eneough though that is the same day as GE Money have up to submit their defence with the court.

Looking at my Subject Access Request I sent to RBS it isnt specific enough, so I'm going to play it safe and do another, what do you think to this -

• Original terms and conditions of the Payment Protection Policy as they stood at the time the policy was started, along with any alterations made to the terms during the life of the agreement, containing full details of the policy cover and any exclusions of the cover
• Acceptance signed by myself to agree the level of payments that would be incurred on the account to provide the PPI, along with the rate of interest that would be charged on these payments

Best of luck with GE - I'm also heading to court on a Data Protection Act with them, the defence is nothing short of ludicrous and will be extremely easy to shoot down in flames!

Ohh well the battle Continues..lol

GE Had till yesterday to submit defence, Just phoned court this morning and they submitted defence yesterday afternoon, Will have to wait now and see what their defence is so I can rip it apart..lol

Well I have now recieved a copy of their defence from their Solicitors Eversheds, To be honest they Contradict themselves a couple of times and try to pass the buck, But that is only to be expected from them.

Will be working over the next week or so on my response etc and will get it off as soon as the stamped version of their defence arrives from the court.

Hopefully now things will start to move a bit quicker..

Oh and any Legal Experts Give me a shout..would be appreciated..

	Are you letting your bank keep your money Are you giving away thousands of pounds?? Many people aren't claiming all of the money they are entitled to when they make their bank charges claims. You have been forced to pay unfair bank charges. Have you forgotten that your bank has charged you inteest on those charges? If you are overdrawn and the bank owes you charges - then your overdraft is made up of charges - money which you bank owes you. Yet you are paying interest to the bank - on your own money!!! Hi Chris,
I pressume you sent it Recorded Delivery to them ?, Once the 40 day time limit has passed I would give them 2 extra days to allow for Post etc then if still nothing I would fire off a Failure to Comply notice under the Data Protection Act. That might get them to get the finger out of their Butt so to speak. You can also of course Register a Complaint against them with the Information Commissioners Office, I did and it did get a reaction..lol

PS: If there's anyone who hasn't got their original GE loan/PPI agreement and who wants to get an idea what they look like, PM me and I will post a copy of mine (circa Feb 2005). One thing that's a quite interesting is that the PPI is included in the total credit rather than the charge for credit!
