Sorry, haven't been around much the last few weeks. I haven't got round to writing to the FOS yet, but planning to do it this weekend. I need to clear a couple of things up though?!

Rule of 78 - Does this only apply to mortages as Barclays have stated?

Hi Milo,

I too got the FOB off letter from barclays today saying that they have enclosed original copies of the agreement and that i ignored my duty of care by not reading the T&C relating to the PPI. They then tell me to go to the FSO!

Could someone answer this please. I'm going to log a complaint with the FOS but I need to know the full facts. I'm not letting these ***** get away with pushing me into an insurance sceme that cost me nearly 3K

Hello Milo,

How can we ignore you:o They have written to you telling you that s78 is for calculating mortgages re ppi Maybe send another letter demanding how they calculate loans and ppi for your file to the fos and court. Turn it round on them. Maybe put at the botttom of your letter that their failure to supply you with this required information with not look good for them re your complaint to the fos or if you take them to court. You have a legal right to this information.

I did write a few letters questioning anything that was thrown at me by them. They think they are so clever, but keep pushing and you will get what you want Your money

Good luck and keep up the fight

Ha - After months of waiting, I had response from the FOS stating that they have ruled in my favour. That was dated the 12th October and I am still awaiting payment from Barclays.

I have contacted my contact at the FOS and I keep getting told that he's chasing Barclays for payment, but surely, if the FOS have made a ruling, then surely Barclays should only have a certain amount of time to repay.

I could do with the cash before Xmas and i wondered what my next options are????

To be honest I won a claim through the Ombudsman and waited a while for payment. I contacted them to ask how long they would give a company to pay up and I just got a 2 line reply saying they don't have any set deadlines. Just keep pestering your contact as much as you can and you should get some luck soon.
And well done!

Yeha, I have been pestering him on a weekly basis. He tells me its nothing to do with them, its down to Barclays. So I told him that he was my point of contact so I'm dealing with him, and will continue to email and call him on a weekly basis until i have my money.

I thinks its crazy that the FOS makes a ruling and Barclays can still mess around as much as they are.
