Capital One and PPI am I entitled to refund

I don't know if anyone can help me, I had to Capital One credit cards, which I paid PPI on every month for about 2 years. I got made redundant and tried to make a claim on this insurance. After many phone calls back and forth, they decided they were not going to oblige and pay the insurance to cover my card payments. They said I had not been employed for a whole 6 months BEFORE applying for the credit cards. So I was not legible for any insurance payments. Would I be entitled to a refund of the PPI payments? Bearing in mind after this I defaulted payments with capital one as I could not afford to pay. This happened a couple of years ago, but capital one have had Bryan Carter chasing payments, which I paid. Now they have Robinson Way chasing for even more money. If they can chase up a debt, why can't I chase up my PPI payments? especially as they said I was not covered, they took my money and ran.

Were you advised that the employment issue would affect your claim when they sold you the PPI ?

If you were unemployed or self employed and you took out the PPI, you had no chance in getting anything paid with their insurance, so you were mis sold.

I would get a full S.A.R. (Subject Access Request) off and ask for your data they hold on you. I bet there are quite a few charges there too you could claim back. The PPI payments will be on the statements as well as all of your transactions. The cost is £10, so send a postal order with your request. It is £10 in total for both accounts, not £10 each account for your S.A.R.

One thing though, keep the charges you are claiming, the PPI, and the default removal if the charges caused this, in one package. You probably will have to file your case in court. I was employed when I applied for the credit card and PPI, they didn't pay it because I had to be employed for a WHOLE 6 months BEFORE I even applied for the card, I hadn't worked for a couple of months before I applied because I was in the USA, looking after a sick parent. When I was in the UK I worked.
