| mbna ppi hi i wrote to mbna on28/1/08 for misold ppi i received a reply on the 4th febuary saying they will provide me with a full response within 28 days which has passed with no further communication how long do they have to deal with this issue and what is my next step many thanks |

did you send Subject Access Request ( Subject Access Request) with the statutory fee of £10 as the request for the data.
If you did, then they have 40 days to respond fully or you can claim non compliance with your request. Data Protection Act - Non-Compliance - Template Letters
My advice would be check out some of the other threads within PPI forum. Read up on some of the material available it is a good help with establishing your case and finding out the information you need.
Also follow some of the other peoples threads on dealing with the same organisation there are severeal preparing to claim against MBNA.

Did you get everything you requested in your Subject Access Request?
Check all the documentation you have received. I am not sure on what grounds you are claiming missold PPI but you need to check every document they have sent. Little things like dates i.e. have they signed and dated the CCA before you. Also look at the Loan Customer duty of care checklist to see what they have discussed or not discussed with you i.e Pre Existing medical conditions, full cost of the PPI etc. Compare the documents CCA etc with any documents you already hold. The wording must be the same on each of them but not necessarily in the same format or layout.
If the Documents back up your case then depending when you took out the loan and I am assuming it is PPI on a loan the next step is to lodge a complaint with the Financial Ombudsman Service for Loans with PPI after 2005 or Court if the loan was before 2005.
You will need guidance from others if you got the Court route, I could not advise as I have not been down that route.
I havn't got as far as you yet as I am still waiting for full response to Subject Access Request.

I am not sure if this will help you to put a letter together but if you check out post no 2 on this link you may get an idea of what you want to ask for...... alanalana PPI claim against RBS (looking for some help) please
You will see my attempt and a better version from hellhasnofury. Just change the wording to suit your own case.

| Re: mbna ppi quick update i have worked out all the charges owed to me and have fired a letter off to these people requesting a refund within 14 days or further action will be taken lets see what happens next |
