Barclays Miss Sold PPI

Hi me again with another question.

I contacted barclays re the above, their first response was the normal "naff off" letter, I called them and asked them to reconsider as their agent had given me the wrong info so it made the policy invalid.

Again was told to naff off. So I called to discuss with the customer relations manager who agreed in the telephone call that I had not been given the correct info and she would look into it.

Cash loan 3000.00 Total amount payable 4279.80 = 71.33 x 60 months
PPI 724.14 Total amount payable 1032.60 = 17.21 x 60 months.
Loan agreement was dated 19/04/06. 15.9% APR

Barclays have come up with the following.
They will refund me 487.47 and have canceled the rest, so the loan is now standing at 2200.00 it was 2687.47 before this refund.

If I have this right, they have not removed the remaining 17.21 per month and out of the 1032.60 they are refunding 487.47.

Can I insist that they refund all the PPI or take what they have offered and run?

Are they giving you personally in a cheque or putting money into your bank account or just knocking the £487.47 of the balance

If they are only knocking this amount of the balance or the loan, It appears that they have just cancelled the ppi and are just refunded the unpaid portion of the ppi. You need to demand they repay you the portion of the ppi that you have actually paid, plus interest at the contractual rate of the loan

They have knocked it off the loan amount. I thought it was a little low but they say it's their final offer.
What would be the best option, try to renegotiate the settlement or the FOS.

Hello Kc,

It appears that they have done no more than cancel your ppi and the balance that is unpaid over the rest of the term, they have refunded into the loan account. so they infact have not given you any amount of the ppi that you have actually paid them.

Personally I would write point out this fact and ask them to refund you the portion that you have actually repaid, that you believe you should be entitled to on the basis that the policy was mis-sold. Advise them that you will give them a further 14days before you forward the case to the Fos or considered commencing legal proceeding to retrieve the money. and don't forget the contractual interest on top.

Speaking of interest, do you know how much interest they charged you on top of the ppi payment???? Do you have your figures and can you post them up for view??????

The figures on the agreement are

APR 15.9%
cash loan 3000.00 Total amount payable 4278.80
PPI 724.14 Total amount payable 1032.60

Total charge for credit cash loan 1279.80, ppi 308.46 (included in the above).

Interest rate 14.970% p.a

It also said "the barclayloan protection premium includes Insurance Premium Tax at the rate of 5%

I do hope they have not charged you for them and juicy cheque for the paid ppi and interest would have been better.

Are you going to pursue them for the remainder

I am awaiting some figures Barclays have sent out as a call I had last night said they have given me a lower APR.

Probably will chase for all the money TBH as it would make a huge dent in the outstanding balance.

Is there a template letter or should I make my own up?

Hi kc,

Banks do not normally send flowers. They may be trying to put you off the scent (excuse pun).

I am in the process in claiming back everything I can for mis-sold ppi HHNF has been a great help. I reckon the widespread mis-selling of ppi is about to become another wake up call for the banks. If you believe you have a case for mis-selling then claim back the full costs of the ppi including the interest. I would also claim back the payments you have already made plus the interest on them. Less of course any money already refunded.

It's amazing how suddenly single premium ppi can be cancelled and proportional rebates returned. The FSA have the financial institutions worried is my guess.

Hopefully we will soon see a shortage of flowers in florists around the country.
