Default WELCOME CAR FINANCE - PPI reclaim advice please..!?

Dear CAGer's,

I really need some advice on what to do next with Welcome Finance.

My wife took out car finance in 2004.

Recently I've been reading up on mis-sold PPI and its unbelievable what these companies get away with.

Anyway, basically my wife explained to me she was never given the 'option' of PPI, but was told she had to have it.

1 year later we decided to try for a lower interest rate loan with our bank. We got the loan and proceeded to call welcome finance for a settlement figure. Of course this took ages fo them to sort out. We finally received the settlement figure and promptly paid it off.

Problem solved......Not quite!

Firstly it turned out they had told us a figure that was too much, but to remedy this issue they would transfer the overpayment to my wifes welcome finance personal loan that she had. Well to this date it has not been done (we've received statements for the personal loan with all account history as I S.A.R - (Subject Access Request)'ed the personal loan).

Secondly, I've been recently checking over the original agreement for the car finance. The PPI was for £2374.61 (basic) before additional charges etc.. with a full repayment figure of £4084.32 (total). I do know we only paid off the basic figure for PPI, but if I reclaim the PPI is it for the basic or total figure?

What astonishes me also is that the final overall settlement figure (for the PPI and car) after 1 year of £276 repayments was roughly the same as the original figure when my wife took the finance out. How can this be? Surely after 1 year of repayments the outstanding balance should've reduced? Also should we had to pay the whole PPI premium on an early repayment or should this of been deducted of what we owed?

Anyway, I've S.A.R - (Subject Access Request)'ed them once. Waited the 40 working days. No cheque cashed and no statements received! I've then sent them a letter before action giving them a further 7 working days to send the information to me. No reply still...!!

So, my question is what next??

Do i file a claim against them? If so, what do i claim for? just the basic PPI or more? How do i word the claim etc..??

Please help me if you can. It would be so nice to claim back what is rightfully ours.

Hello,

Did you send the letter recordeded delivery and do you have proof of postage, You can chect on the Royal Mail website if you have keep the recorded delivery slip. If you did and they signed for it,print of a copy and send them a Data Protection Act non-compliance letter you will find it in the bank charges template letter stickies on the main forum of the forum. Also report them to the information commissioners office.

If you have no proof send them another pain in the butt but necessary.

Hi all,

Can anyone tell me the actual places I should be writting to for reporting Welcome Finances 'unwelcome' approach to dealing with my S.A.R?

And if possible a guide to what I should be stating in my letter of complaint or a link to someone elses thread in the same sort of situation.
