Default pursuing G E home lending help limitation

Hi all,
i am currently persuing G E for ppi mis sold on two loans from 2002, i have sent complaint letter/refund request, and they have replied saying a copy of your agreement shows that you requested no ppi, and the box is zero.

However the ppi premium has been added to the loan and then they got us to sign the application form incl ppi in excess of 2500 on each loan!

G E home lending say that we may have bought ppi from broker whom is G E direct, (sister company?) and yet it was G E home L that sent me a disbursments document for each loan, clearly showing 2500+ from each loan for ppi insurance.

Can anyone help with limitation times for court action, i know it is usually 6 yrs for ordinary agreements , however can anyone confirm 12 years for agreements executed by deed, as these loans were mortgage loans.

many thanks, jimothy

On a claim of misselling the limitation act is different.
You have 3 years to act following the day you found out about it.
I.E. 3 years from now.

Hi,
thankyou TC and HHNF,
yes i do have agreement selected no ppi and zero in the £amount box, also have a copy of the application form they got us to sign with ppi, no details of cost or duration of ppi on it.

Incidentaly the application form is dated after the ca agreement to which they added ppi of 2750, very cleverly concealed.

I have now sent the complaint and refund request to G E direct and await their heartfelt appology and cheque opps just dreaming......

I have started to research court action, although we would all welcome an easy journey with these cases, part of me wants to exposse them in court.

There are other flaws in the agreements/application forms too, like as my husband is disabled, only my employment details were entered on the application, yet on the back of this application is the ppi signature bit, and they have ticked 1st named only, which is my husband (1st named on the ca mortgage agreement) and this policy is in his name only not mine as the employed applicant.

Anyone else had or are dealing with these highway robbers? i would be happy to compare/ share similarities, newly found info or anything else that may be of intrest.

kind regards
jimothy

Hi.
Not yet read a much more clear cut case of deceit.
Im with holding the desire to call it theft.
As you read more you will see that nobody "likes" to give refunds easily.
Stay on top of your actions, and dont give them an inch.
