Hospital/income plans???

Hello,
I've been reading up on mis sold PPI's and have realised that I have been paying it on my Next account, apparently I should have unticked the box? anyway I have sent them a letter cancelling and asking for a refund.

Back some 5 years ago, my partner took out a business loan with Lloyds TSB, the manager explained that the only way he could offer this loan was if he took out 3 separate insurances to cover him against critical illness, accidents and healthcare etc, this meant that he would get his salary paid if hospitalised for more than 3 days, lump sums if he was critically ill etc. The only one that he has used is the Bupa cover, as he had a problem with his wrist which needed an operation and as the waiting list on the NHS was more that 6 weeks he went to see a consultant at Bupa and had the operation some months later.

My question is whether the same would apply to him as with the PPI cases, as the manager distinctly said that he would not get the loan if he didn't take our the cover.

Can anyone help to shed some light on this?

Has he got a copy of the T & C's of the original loan?

I don't think so, I will dig some old files out and have another look, does this matter, can he get a copy from the bank?

He can - best way is to send a CCA request with the £1 fee, which will show him exactly what he signed up for (if they can produce it).

Sorry to sound dumb but what is a CCA? Is there a template letter?

CCA is a consumer credit agreement, which your partner should have signed when taking out the loan. This should give all of the terms and conditions at the beginning of the loan so that you can see what it says about PPI.

I sent a CCA letter on 10th April 2008 but to date have had no reply, can anyone advise.

Hello 2392ann,
I understand that the bank or whoever have a 14 days statutory period in which to comply with your CCA. If they fail to produce within that timescale you can proceed to complain to the Information Commissioners Office or go to Court to get them to comply with the Consumer Credit Act 1974. As they have not responded then they are in breach of a Legal Act. I would start with a complaint to the Information Commissioners Office but they are swamped and take up to 6 weeks just to acknowledge your letter. I am not sure about the timeline for Court action as I have not been down that route.
