Currently fighting DAF through the courts, they want 4000 odd pounds off us and have applied for a charge on my property, even though it clearly states in clause 7 ( Additional Insurance Protection ) of the credit agreement, "If you are joint customers, do you understand that only the first named person is insured for payment protection."

My wife is the first named person. So according to clause 7 I am not covered by payment protection. If this is so, how can they apply for a default judgement against me for PPI that I am not liable for and for a charging order on a property that is also in my name?

I also suspect PPI was mis-sold as they only asked us if we were off work at that time with any ailments. The answer was no. They did not ask if there was any longstanding medical or health problems, of which my wife has two which she discloses quite freely to any and all insurers that ask.

The credit agreement was signed 04 / 12 / 2004.

While this case was going through litigation YCC / DAF sold the debt to a collection agency. Is this legal ?

Any more advice would be welcome.

If the credit agreement is in joint names, then you are both liable for the sums due within it. When was the judgement obtained?
