I'm doing the leg work trying to get single premium PPI refunded for my wife,but Creation are trying to play hardball
the sum involved including loan interest which was added to the PPI bottom line is around £460,and there is around £800 still to run on the loan,so this would nearly kill it.
I have written to them several times,and quoted the OFT common eligibilty factors-ie 16 hours a week paid employment etc etc which is impossible as my wife was claiming Carer's Allowance before the loan was taken out.The signature on the agreement is supposed to demonstrate that the PPI was fully expalined to her-clearly this was not the case.
They have written back highlighting the "common" eligibilty requirements,which they "also offer",but that they are not the only criteria used for PPI,and that they are refusing the refund on these grounds.
this sounds like total BS,of course,but any assistance at this stage would be much appreciated.

Nice to see you over here. The reclaiming of mis-sold ppi works on the same principles as the bank charges, except they deny it even more. They will deny and refuse to answer any issues that you ask clarification on.
So you have caught them out on one reason, and they state that is not the only criteria they base their mis-selling on:o
Yes It does sound like total BS to me as well.
Is the ppi still running? If so, if you cancel it, the balance of ppi and interest still owing, will be refunded into the loan balance, and reducing the amount owed,so you will not pay any more for it. Then you go after what you have paid for the ppi and interest. There is guidence from the FSA regarding cancelling ppi and fair refunds to the customer. You will find it in the ppi sticky by Zootscoot.
They might pay hardball, but you can play it harder.

The fos, I believe will only investige a complaint if The loan was taken out after 2003/2004. Will have to clarify the date. So it will depend when the loan was taken out.
If you are out of their jurisdiction, there is always the option of court  That normally makes them sit up to attention. |
