hi all I just thought I would give people some up beat news about claiming PPI... This case is a little different as they can not find our agreement..

THey have refunded all the PPI over £3000 and cancelled PPI so loan payments are somewhat less...

I have now sent letter claiming back all interest as they can not provide me with a copy of agreement they can not enforce loan... therefore they can only claim back amount of loan minus all interest... I hope I have got this right... I will post on this thread their response.... good luck to you all

Hi guys sorry to hijack the thread but I am in similar position... I have a loan with nawest and they have just , very quickly refunded PPI I had paid on the loan... when I dug a little deeper they told me they did not have signed copy of cca... am I right in thinking they should now give me all the interest paid on the loan.... What can i claim back I owe about another 4 years on the loand which is made up of about £1000 plus all the interest....

what form of attck is there for this I have asked for signed copy and they have stated they are not obliged too... they just have to give me the details from it... as they would not ever offer interest free loans...

Is there any case law that you know of to back this up and is there a template letter?????

Hi yes I sent numerous letters requesting cca they have told me now 3 times by letter they have not got copy...

I have paid £14900 of a £16000 loan which was increased to £19000 by PPI which as been refunded....What should I be now saying or requesting... there last letter claimed they were not legally obliged to provide copy but just to inform me of the details of the loan... pretty sure this is not true...

What template letter should I send and what can I ask for????

Hi fergal,


If you have it in writing that they have admitted that they do not have a copy of your agreement, then do nothing. Do not pay them anything!

They do have to provide a copy of the agreement under s77 or s78 of the CCA. Until such time as they do provide one they are in default and cannot enforce the agreement.

It's your call really!

You are well within your rights to cease payments whilst the default continues! If you read around some of the threads, you will see that a lot of people have indeed stopped payments once the company in question have defaulted on a CCA request!

It's just a question of whether you feel comfortable with stopping your payments!
