Sorry for going on a bit, but i had this thought, if its true what the police said to me and every road accessible to the main roads be it private or not, comes under the road traffics act, right, does this mean that these clampers can issue tickets under their
noses and get away with it ! doing the policing themselves where does it stop ?..can they add on to their signs that they could issue tickets for worn tyres, wiper blades,emissions, etc, could i buy a stretch of road and put speed cameras and signs on it record their numbers get their addresses from the d.v.l.a and issue them penalty notices ?.....


We the undersigned petition the Prime Minister to Outlaw Private wheel clamping and vehicle removal companies.

The police, as per usual, have a simple minded view of things. The definitions of a road under the RTA will differ for various purposes. For the purposes of insurance and drink driving, for instance, the definition is different.

Listenning too much to what cops say is not wise, they get it wrong.

A private road or private land is such that is not maintained by the council. The land must be owned privately, it's pretty much that simple.

You then have the implications regarding signs etc and so forth but that convolutes what is reasonably simple. SO these PPC aren;t issuing the tickets in place of the cops because the cops cannot ticket on roads not maintained by the council and subject to restrictions as described under the RTA.

just to clarify one point which maybe of use to you.

if the private road juctions with a public road,
unless it is gated [and by this i mean usually closed]
it comes under the same laws as any public road and police have the same powers, as if public.

i sufferred very badly with several of my farm tracks being used by boys racers to go down and smoke dope.

regardless of how securely i made the gates they are always breached.

having been visited by the local police liason officer
i removed the gates and the police now patrol the area

problem has now gone.

just my 10p
