Default speeding fine -willing to pay but..................

My son got caught by speed camera. Thats OK as he was doing over limit.
He is a student so I tried to pay the fine for him.

date of offence -22/8/06
received fixed penalty notice dated 14/9/06
returned to them Oct 06 but with wrong number on debit card instruction (1 number out) so sent back to him 11 December
Re-sent 14 January
money taken by direct debit but refunded same day as now out of time.
Letter I have says payment fo £60 was taken before it was noticed that the police had reverted to a court hearing.

Is there anything I can do? I have always been willing and tried to pay the fixed penalty. Seems a waste of court time .
Any ideas what he might get?
He was doing 54 in a 40mph area

Default Re: speeding fine -willing to pay but..................

It is very unusual for a camera partnership to give up on the cash like this - if it goes to court, they do not get the money it goes to central funds.

I can only presume that they have already laid information with the court and that he will get a summons shortly - it can take 3 - 4 weeks.

In court, the Mags will probably slightly increase the fine and the CPS will ask for costs of about £35 - this amount will be on the summons.

One question - if they have rejected the payment, where is his licence? It should have been sent with the payment and he will need it for court

BTW, if this is Gwent constabulary, they have a history of getting the paperwork wrong for the court. Try PePiPoo: Helping the motorist to get justice for help in how to fight the summons. Whilst, morally he may be culpable; the law has to be followed by them as well in order to prosecute successfully.

looks like he went over the time limit for paying the fixed penalty. Doesn't seem fair in that he puts his hands up to this and has been trying to pay.
He's not denying or ignoring he fixed penalty.
His licence was sent back with the rejected conditional offer.
Its not Gwent police - its Cleveland. he was visiting friends.

He probably wont be able to attend court . It'll be in Middlesborough and he's in University in Bournemouth. Train fare is around £150
Can he put in a written defence?
