| | Basic Account Customer | EuroCarParks-Wrong Bay On Saturday I took my son to Argos in Crewe Cheshire to spend £10 on a birthday present. I parked the car behind a 4x4 in the middle of the car park not realising it was not a proper bay.. It was NOT causing an obstruction in any way even if a 40 ton truck has decided to park there.
I duly paid my 2hr car park fees and 20 minutes later returned to my car only to find the following penalty notice on it.. 
For obvious reasons I have taken my number plate out..
The very indistinct writing for 'Other' says ( I think as it is very faint ) something like 'parking outside normal bay'
Where do I stand with this. I had a look at other threads and they seems to concentrate on council car parks..
I'm not loaded with money at the moment and I'm really angry that I should receive my FIRST parking ticket in over 30 years driving for such a stupid reason...
I obviiously need to pay the fine in the next 14 days unless someone can come to my aid...

It is fairly obvious that your company is relying on an implied contract being formed by the driver when parking, by virtue of the signage that you have in place.
You cannot be relying on Trespass Law, as you could only claim the landowners actual losses - which for not parking correctly in a bay are zero.
Given then, that your company is relying on contract law. Only the driver can form any contract (implied or otherwise) by the act of parking. The Registered Keeper has no liability simply because he/she is the RK.
So my, entirely reasonable, question is - how do you identify the driver in order to pursue any ticket?
If you pursue the RK, can you show me where, in law, the RK is liable? |

They will bluff and lie about bailiff's, legal teams, etc. Eventually they will go away as there is nothing they can do. |

i let someone of today, i gave her to opportunity to move her vehicle to the correct part of the car park and out of the disabled bay, which she obvously wasn't, as she RAN from her car, and the thanks i got for saving her a£50 quid ticket [edit]. well the next person who parks there illigaly can thank her when i slap a ticket on there motor, you do someone a favour and get abused verbally.
well thats the end of mr nice guy. tickets for everyone now.
I try to play fair for what? abuse.

The physical abilities of the driver are not necessarily indicative of disability of the badgeholder..
Additionally, Council-issued disabled badges (blue badges) are valid for parking on publicly controlled areas. They have no validity in on private land. You are not qualified to know why a badge was issued (it may well not even be for the driver); unless your signage is very specific about the type of disabled badge acceptable, any - even a home made piece of A4 can be a valid disabled badge within the terms of your 'contract'.
You have also not answered my simple question of how your company traces the driver for any unpaid ticket - the DVLA cannot give you this information. |

Just because someone can run, doesn't mean they aren't disabled, mind you that'll be next on your list of breaches. Disabled Person Caught Running Whilst Parked In A Disabled Bay - Penalty £135.
