Default TMA 2004 CEO employment update

There has been several queries around press reports regarding Councils employing new CEOs after 31st march. The latest news is that the following Councils (see below) are the only ones it concerns. On street enforcement is not affected (unless a free bay) as they enforce on behalf of the County Council. The problem only affects off street car parks and any CEOs employed after 31st march.

well worth reading.
any non metropolitan district council is in the frame, they can be checked here
A to Z of local councils : Directgov - Directories

in the Waldron note is dated May 2nd so it is likely/probable/ that the affected councils fell foul of these after the end of March.

The Councils were aware of the issue before the 31st march and it has little affect. The Councils would have already employed staff to enforce car parks prior to taking up DPE in march and these are now still legally enforcing. Any new staff can only enforce on street for the time being so the only inconvenience is in the rostering of staff duties. PATROL is unaware of any tickets being non compliant due to the situation.

I didn't know you had access to all the records of PATROL...


"Where any PCNs have been served by a CEO appointed by a district
council since 31 March 2008 in respect of district council provided off street or free on street parking, we strongly recommend that you cancel that PCN and inform the vehicle keeper that you have done so."

this is just one of the mistakes in TMA.

e.g.
The regulations for Dropped footways and double parking contain an oversight. TMA does not include the exemption previously allowed for enforcement without signage.

It came to 'their' attention (ie the DOT) because the majority of Councils already knew about it. As for the access to PATROL records they are freely available under the Freedom of Information Act so yes I do have access.

show evidence for your assertion and I will change my view accordingly.

Wow and you Freedom of Information Act'd all the PATROL records, they complied and provided ALL their records. you want through them all and found that the result you did. sorry again.

what about the latest Waldron note (June) ?
