Default PCN - Incorrect?

Hi there,

I've recently received a PCN for parking on a single yellow line outside of my accommodation.

I intend to challenge this due to the fact that there are breaks in the yellow line, and it is not enclosed by T-Bars. I will obtain pictoral evidence of this before submitting my claim.

The other glaring mistake I noticed, was on the letter sent to me:

I've noticed that the CEO's ID is: BN BN163.. surely this is a mistake.

Would this hold up as being incorrect, therefore invalidating the PCN altogether.

I will probably go down the route of the single yellow line, and the Davies vs Heatley case, but I was curious if this could also be incorrect.

Also, any help with how to begin would be appreciated.

(Can I e-mail my dispute, or must I put it in writing? Also can anyone link me to a template letter?)

NO it doesn't.

As there is no legal requirement for the CEO to either be identified or sign a PCN, it follows that even if either of these is wrong, it does not invalidate the PCN

Ok, thanks for that.

What are the exact details of the broken yellow line case.. as there is a faint T-Bar at the end I thought there wasn't one, but the line is broken multiple times before it reaches this end.

Also, does it matter that I'm taking photos of just the road, my car has been moved.

There is no such thing as the 'broken lines case' every case regarding the condition of lines is decided on its own merit. Davies vs Heatley which is often dragged into this scenario covered the use of non compliant lines (a combination of dashed and solid white lines) which is not the case here since the line is of the type specified for the restriction what is being questioned is the condition of the markings. There is a couple of pages in the last PATAS annual report regarding yellow lines, which may be worth reading. Photos of the street ideally should be taken at the time of the PCN anything afterwards is not in my opinion that relevant since the condition of the lines may have changed or been altered since the contravention.
