Default penalty points for not using my car

Hi can anyone help?

my cousin used my car last year and got flashed. i sent the form to say who was driving but they still put points and fines on my license.

also i got stopped for a bold trye and was given a 7 day period to change the tyre which i did do and send the stamped form by an MOT garage back to the stated address. later i found that i was still given points even though i repaired the fault within the given time. I thought the whole point of this was so that you don't get points.

If you had informed the police of who was driving the car, then they would have sent a notice of prosecution to the driver you named. Did you at any time receive a summons in relation to both the speeding and the bald tyre matter? And if so, what did you do on receipt of the summons?

I received a form to provide details of the driver which i completed and sent back. i don't know what happened after that.

i did not receive any summons with regards to the bold tyre or the speeding. the only reason i found out was because i got stopped by the police who said i had no license and when i got in touch with the DVLA they said that was incorrect we just needed your old license back so we can add points to it.

If you haven't received a summons for either matter then you can apply to get the convictions set aside. I'm not sure of the procedure for this but the magistrates court shuld be able to give you details of how to do this.

Your local court would be a good starting point. If you have your licence back with the endorsements on it you will see a 4 digit code within each endorsement which relates to the court. Your local court should be able to tell you which court you need to deal with from this code.
