Default HELP NEED!!!! 353.74 £ paid to Equita

Hi Everybody,
i took a fine for parking in a "parking permit Zone" on the 25 of july 2007.
i was on holiday and when i came back there was nothing on the car.
then I moove to another place on the 15 of september 2007.
I send the notification of the change of the address to the dvla around 15-20 october '07.
Thursday 10 aprile 2008 i found a "removal notice" letter, after few phone call on friday to Equita agency and to the City council o descoverd that the fine was sent to the old adress.
so everything went to the equita agency, i call them and a guy told that if i didn't pay "353.76£" within 2 hours they were coming to take my car!!
i was quite scared so i paid immediately, but i don't think it was completely my fault! and i didn't even had the chance to pay the ticket wich by the way was only 95£!!!!!
the guy from the Equita agency told me also that "this was a decision taken from the Court and that now was too late to do anything else!"
I am afraid that this is not true, can the court decide legal things on my person without even letting me know????
I hope that someone will be able to give me some advice.

It is clear from your post that you need to file an Out of Time late Statutory Declaration with the Traffic Enforcment Centre.

On the PE3 you need to state that you did not receive a Notice ot Owner as it would appear that all Statutory Notices had gone to a previous address.
