Derby PCN

Hi,

thgis is my first post ever so forgive me if I seem dumb please.

I received a PCN on my dashboard after being 10 mins late back to my car in Derby, and I am wondering if there are any loopholes to avoid paying this stealth tax? I have 14 days to pay it or appeal. All I can see so far is that the signature is a mere line, and the date field at the top simply says: "Served on: 10/04/2008"

"Code 05"

"Date of contravenbtion 10/04/2008"
"Time of contravention: 11:20"
"Location: Bramble Street, Macklin st Area"

Then all details about my car, then " A penalty charge of £50 is now payable and must be paid not later than the last day of the period 28 days beginning with the date on which this PCN was served (i.e 07/05/200"

"See reverse for how to pay, how to challenge this PCN, what haapppenss if no payment is made"

Then underneath is a detachable section which says the PCN no., "served on: 10/04/2008 at 11.21

my reg again, then "contravention: Parked after the expiry of paid for time

"Code 05"

Anyone think theres any way out of this one?

is this a local authority PCN or a private parking company?

Sounds fully compliant with the TMA to me.

When it seems it was issued on 10/04/08

Issued 10/4/08 = Day 1
7/5/08 = Day 28

If I was the OP I would ask for a copy of the TRO giving rise to the restrictions and I would take a look at the bay markings against the requirements of TSRGD.

Ah! OK then, what was the PCN doing on the dashboard? Was the window open?

Its a Derby council thing, not a private one.

TRO = Traffic Regulation Order. The "Law" that allows restrictions to be enforced

TSRGD = Traffic Signs Regulations and General Directions. That specify how signs etc and parking bays are to be marked.

Oh just had a quick thought - Does it matter if some of it (the PCN) is faded?

You can hardly read where it says Bramble Street, and the till roll was obviously about to expire (he must have been busy!) as it has a pink bar all down the middle of the ticket.

Does this make any difference?

I think the point would be is that you CAN read it says Bramble st, if you couldn't it would be a different matter.
