For those of you who think refusing to name the driver is an option; think again - judges generally side with us when it comes to slippery eels trying to avoid paying and they can and do make judgements against the registered keepers of vehicles. | OK - Usual routine - Details and transcripts of your most recent successful cases required forthwith - the last 10 should do nicely.
Failure to do so may result in your credibility being shot. |

I have absolutely no doubt that if a private parking company actually did their job properly, prepared a reasonable case, outlining reasonable loses to a judge, relying on properly singposted areas in accordance with guidelines and making it quite clear to everyone that they are in breach of a reasonably constituted contact and not breaking the law, they would have every chance of winning their case.
The problem is that the majority of firms in this business rely on shortcuts, untruths, intimidation and ignorance of the law by those that you target. As a result, the prospects of your success are going to get less and less every month as people get wise and produce properly documented and formulated defences.
If you are one of the 0.005% who actually do the job right and get results, congratulations. You will get no argument from us. If you are in the other 99.995% of the thieves and scammers, then I would suggest you start getting very worried for your business because the tide is turning in favour of a properly regulated industry where the low-life get rich quick scheisters which currently infest it will not survive for long.

Our signage is very, very, large. If you can't see it, then frankly you should not be driving.
We obtain a good success rate through being open and honest. The registered keeper is our first point of contact in unpaid cases, and while they may not be the driver, in around 80 percent of cases they were - and they know it. So do the courts. |
never mind sineage ,if you dont know the identity of the driver then how do you establish contract. So how do you win if you cant prove anything
Me thinks you are a wind up merchant |

I have the impression that one or two pseudo legal types have put this message about, which is then blindly echoed by numerous armchair pundits.
In court, we dont have to. Come to court with me and see what happens. |
