| | Basic Account Customer | Glasgow City council PCN's Perhaps some of you on this site could provide me with a little know-how and or advice on an issue i have with two pcn's from glasgow city council.
At the end of december i received notice from a company(sheriffs officers) called 'Scott and Co' in relation to two unpaid parking charges from june 2007.
Now this surprised me because
1.) My company pay all my parking fines as i can receive them through being in meetings that go on longer than planned, being up on scaffolding longer than expected etc etc
2.) I have never received either of these notices.
3.) I never had any correspondence regarding the notices from glasgow council, only the sherrif officers
I sent Glasgow city council a letter stating that i had never received either of these tickets, and requested the proof that these had both been served.
This was at the end of december, sent recorded delivery so i know the letter has been received.
The council have not replied to my letter, despite promising me that they would have dealt with it by the end of the week, two weeks ago.
The company scott and co. have now introduced charges for these tickets still not being paid!! despit me telling them that the council have not responded to a letter sent recorded delivery. Glasgow have definately received it, as i have the recorded delivery proof and they have also admitted this on the phone.
My questions are:
1.) Due to the length of time taken by the council to respond(i.e over 30 days) are these tickets still valid? it seems they have no proof.
2.) As i never recieved the PCN's themselves - do i have to pay £90 a ticket or do i have grounds to pay £30 a ticket?(the 'if you pay within 14 days') option
3.) The charge applied to the tickets, is there any way i can have this removed?
Any help or advice greatly appreciated. To be honest i dont doubt the parking offences occured but i find it very strange that i never recieved the PCN's, and the first correspondence i received was from Scott and Co. |

As I understand it, the tickets have been registered as a debt as you haven't appealed, and the sheriff officers will try and get payment off you - how much is it anyway?
You should ask the council for the PCNs, NTO and all other correspondance relating to you - a subject access request - enclose a tenner and they'll do it. Then I think you can complete a statutory declaration to get the debt set aside and allow you to go back to the NTO stage which will allow you to appeal or at least pay the reduced rate I think.
You could also post up the letter, removing personal details etc, so we can have a look. You might also get help over at FightBack Forums -> Parking Tickets
There are also posts by bmwman on here on the subject of stat decs. |

I have requested copies of the pcn's and nto's and correspondence, however did not include the £10 as i wasn't aware i had to word it as a subject access request.
Given that they have not even acknowledged my letter, and that it has been sent recorded delivery, with delivery proof do the council not have some time limit to reply to my request? i.e 30 or 60 days?
I have checked today and this was sent on the 03/01/08

Forgot to mention, the charges are £90 each so £180
Plus a 'charge' that has been added - im not aware of how much but i'd hazard a guess at £30 a ticket.
Not a chance i'll be paying that

I stand by all advice I give, and take time to look up links, Thehre is much info on fighting private tickets not too much on those issued by councils.
If you wish to complain about any comments made by myself then why not refer it to a moderator.

since your on line now can you recall any member who has experience with PCN, I did suggest chesterexpress as he is a partner in a legal firm, however not his field.
Would it be possible for the name of some members with experience to be placed at the head of each forum
