'Do It Yourself' parking charge Notice Kits

Whilst at a cafe earlier, I was privvy to see the owner 'ticketing' a car in his car park.

Getting into a conversation about the legality and enforcement of it all (pointing him to read some of the threads on here !), I asked him which PPC he used.

He replied that he does it himself. Purchased a kit being sold on ebay, which came with signs, tickets (with a space on the back to put the payment address on it), and those plastic yellow wallets to put the tickets onto the car with.

He says at leas he gets the chance to either enforce it, or forget it. And theres no hassle in cancelling the tickets.

He didnt mention that he keeps all the profits !.

Ive had a look, and cant see anything at the moment on ebay. What next !!!!!.

It is certainly no worse than using a "proper" kit from a PPC. After all it is just a few signs and a bit of stationery. As a landowner of a car park a cafe owner can probably get registered keeper information details from DVLA based on the infamous "reasonable cause" provision just as easily as the PPCs seem to manage.

The Registered Keeper defence defence is still there and is just as much of a problem for a landowner as a PPC.

Cutting the PPCs out of the picture and setting the charges in line with actual losses may be an option for a business which is sufferring genuine abuse from non customers using the car park. The landowners are certainly in no worse a position doing this than employing a PPC and there is the advantage of retained control.

Other parts of contract law aside they would certainly be in much better position on the charging side of things if they were claiming actual, provable damages rather than the current practice of a random figure plucked from obscurity or set by the greed of a PPC.
