can someone please advise me how to fight a parking penalty served after a car has been sold. Bailiffs involved and my sister has been threatened that her locks will be changed and it isn't even her parking fine!!!!!!

She sold the car prior to this ticket, please tell me what she can do?

the ticket is council and she has received only one letter from bailiffs on 3/1/08 and then threat to change locks on 8/1/08!!!! Surely this is not right or legal....

Surely if the Council has given the Baliffs your sister as the owner they must also have sent her the previous letters regarding the PCN. If not she needs to contact the Council and explain the situation. She will need to swear a statutary declaration (there is a cost for this) and the PCN should go back to the appeal stage. She can then appeal and say she was not the owner.

If you take the statutary declaration to your local County Court you can swear it there and get it stamped. There is no charge and you don't need an appointment.

As I explained all she has got are two letters from the bailiffs and nothing else, who foots the cost for the statutory declaration and where does she get one? Surely not my sister when it isn't her PCN?

Telephone the TEC (Traffic Enforcement Centre) at Northampton and ask for the stat dec form. You don't need to pay to have it sworn as I put in my previous post.

got the forms, going to courts to have it signed, has my sister made an error by signing & dating the form before going to the court or will she have to sign it again, or will they accept it and have it sworn, it's all quite stressful...
