Default PCN for dropping kid off at school

I dropped off my daughter for school at 8.55 only to return with a PCN on my car.

I parked my car with 2 wheels on the pavement outside no 61. There was no restrictions, no signs , no yellow lines and I was not causing an obstruction. on the ticket it stated from 08.58 to time of contravention 09.00. and section 62 was used . I asked the warden why i got a ticket he responsed im here everyday, (he's not) that the area is a complaint area and its a new thing the council is implementing and its illegal to park on the pavement. I know loads of places locally where parking is done like this.

what should I do?

(a) The grounds on which the parking attendant believes thai a penalty charge is payable with
respect to the vehicle is stated overleaf under the introduction "who had reasonable cause to
believe that the following parking contravention had occurred".

(b) The amount of penalty charge payable is stated overleaf. An explanation of the time periods is
given below.

fcj The penalty charge must be paid before the end of the period of 28 days beginning with the date of the notice. It is the full amount which must be paid before the end of the 28 day period.
fd) If the penalty charge is paid before the end of the period of 14 days beginning with the date of the notice, the amount of the penalty charge will be reduced by the specified portion (509r). It is the reduced amount which must be paid before the end of the 14 day period.
(e) If the penalty charge is not paid before the end of the 28 day period, a notice to owner may be served by
Hounslow Council on the person appearing to the Council to be the owner of the vehicle, at which time the
full penalty charge becomes payable
(f) The address to which payments of the penalty charge must be sent is The Director of Finance,
Civic Centre. Lampton Road. Hounslow TW3 4DN. There are also other
methods of paying as described below.
INSTRUCTIONS FOR PAYMENT ONLY
The penalty charge is reduced by 50% if payment is received before the end of the period of 14 days beginning with the date of the penalty charge notice.
Please see overleaf for charges.
Payment can be made using the 24 hour payment telephone line 0845 1300 555. Please have your credit or debit card ready to respond to the auto-payment prompts.
Postal payments only should be sent to: The Director of Finance, Civic Centre, Lampton Road, Hounslow TW3 4DN.
Please ensure that the cheque or postal order is crossed and made payable to the
LONDON BOROUGH OF HOUNSLOW. Please write the penalty charge notice
number and vehicle registration number on the back of your cheque or postal order.
A receipt will not normally be issued unless a stamped addressed envelope is supplied.
NB: NO CORRESPONDENCE SHOULD BE SENT TO THE DIRECTOR OF FINANCE.

Please quote the penalty charge notice and vehicle registration number on all
correspondence, and provide a full postal address for us to reply to you.
Failure to do so may cause delays in responding.
The London Borough of Hounslow will use any data collected through the issuing of this penalty
charge notice for the enforcement of traffic offences and other associated purposes. This data may
also he disclosed to the Association of London Government and other enforcement agencies.

We need to see a scan of the other side of the ticket.

At the moment, from the front alone, the PCN is void. Two things immediately jump out

1) Details of the discounted period are printed on the payment slip, which does not form part of the PCN.

2) There is nothing about a Notice to Owner being sent if unpaid after 28 days

Parking on pavements causes
1/ Damage to the pavement (which is paid by us through the council tax)
2/ Danger to people with poor sight
3/ Pram and wheel chair users obstructing there passage
4/ Possible altering wheel alignment and making the car unsafe.
5/ Poor message to children regarding attitude to law and rules

No point is trying to find a technicality to try and wriggle out of the crime
The photo evidence will prove that you are guilty
An offense has been committed and you must pay
Only £50 what`s the problem (for the moment)

You do so here too.

Parking contraventions are neither crimes nor offences. True the motorist is required to obey the law but then so is the local authority. What this site and others like it do is to go some way to redressing the unequal balance between Local Authorities and the Motorist.

I have no idea and care less for your motives but be assured that for every foolish and ignorant post you make there will be many others who will be more constructive.

In some places it is lawful in others it is not.
In all cases where it is not lawful, enforcement must be lawful in order to obtain payment of a penalty from the wrongdoer.

There's a London-wide ban on it.

Near where I live/work, there are some actual parking spaces marked part on the road, part off it - so it is 'allowed' - and actually encouraged - in some areas.

IIIuminati I will ignore your post as it does not help me. If I amin the wrong i will rightfully pay for PCN as i have done so in the past.

Someone suggested I contact the council and ask them when was authority given to the wardens as it was only the police who could that.

The PCN is void IMO.

Under S.66 of the Road Traffic Act 1991, the following must be displayed on the PCN.

(3) A penalty charge notice must state—

(b) the amount of the penalty charge which is payable;
(c) that the penalty charge must be paid before the end of the period of 28 days beginning with the date of the notice;
(d) that if the penalty charge is paid before the end of the period of 14 days beginning with the date of the notice, the amount of the penalty charge will be reduced by the specified proportion;
(e) that, if the penalty charge is not paid before the end of the 28 day period, a notice to owner may be served by the London authority on the person appearing to them to be the owner of the vehicle;
(f) the address to which payment of the penalty charge must be sent.
The tear off slip is NOT a part of the PCN - this has previously been established. Thus 3(b) does not appear on the PCN (it only states the amounts on the tear-off slip)
