Default Euro Car Parks 70 Quid Fine Help!!!

Hi I Drove In The Exit In Islington Sainsburys Run By Euro Car Parks Not Know It Was A Exit As No Barrier And The Sign Was Hidden Behing The Railings!! I Got Given A 70 Quid Fine!! I Took Photos And The Man In Box Said,,oh Yes We Had To Put It Behind The Railings As People Kept Hitting It,,lots Of People Keep Driving In The Exit!! ,,i Said Does That Not Make U Thikn That It Is Not Clear

Help,,can I Apeal To This Fine!!

I think I would ask them by what authority/statute they can erect road signs and by what authority/statute they can enforce said signs.
Also how did the come by your address? If they obtained your address from the DVLA how did they obtain it from the DVLA and by what authority/ statute they got it from the DVLA.
You do not have any sort of contract with them so they can not sue under contract law and if they want to sue you under what law do they propose to do it if you refuse to pay?

Hi, It's a private company, as Badger says - they can't fine you. Lots on this forum about private parking tickets - don't pay them, they are virtually unenforceable.

Do you have a scanner or camera phone? If so can you post up the paperwork you've received from Euro Car Parks - Parking Charge Notice and any reminder letters?

This does not really require a lawyer, the priniciples are well known and understood.

1. It is a private parking company hence we are talking about an invoice not a "fine".

2. Since it is private we are talking about a supposed implied contract and an alleged agreed charge for non compliance with terms and conditions.

3. The terms and conditions would have to be prominently displayed for any chance of an implied contract to be formed.

4. By the admission of the Parking Company's own staff, these terms and conditions were not displayed therefore there was no chance of the OP agreeing to them.

There is no contract therefore there can be no charge.

And I really doubt that even if the OP had seen the contractual agreement signs, that it had anything at all on it stating about any charge for 'coming in the exit road'.

Perhaps some enterprising ppc will have a go at ticketing for this.

My local retail park has had all its white lines repainted, and its 'one way' system changed. There must be about 600 cars a day that go the wrong way through it. If there are any PPC's that want to put a camera up, and some 'contractual one way only or you get a £100 charge' signs up, I will take 50% as a fee. !!!!!!!!!!!
