Default Parking bays and resident's parking

Hi all,

I have been working in a shop in fairly central London for the past 6 months. I have been parking outside in bays which are monitored between 1.30pm and 2.30pm for resident's permits monday to friday.

I have managed so far to guard my car against traffic wardens, but last week I received my first ticket, which I have paid.

I told my boss, and he was adamant that you are able to get out of tickets if the bays are not marked in accordance to the law. He says that he saw a clip on tv about a man parking in Permit Holders Only bays, who managed to get out of parking tickets because the gaps between the lines were not exactly 60cm apart.

Does anyone know if this is true? Are there any further details on this matter?

The TSRGD is the statutory instrument that governs signing and lining for roads and sets out the dimensions lines have to be and the tolerances allowed. Diagram 1028.4 is the marking for a permit bay and yes, the lines should be 600nn long with a gap of between 600 and 2400mm. So possibly you may be able to appeal if the lines are not within the tolerances plus/minus 5mm I think?

You cannot appeal once you have paid and its not really worth risking continuing parking there just on the off chance you will get any further PCNs cancelled for wrongly marked bay. Residents have paid to park in those bays and you are preventing them from parking legally.

Many thanks for your help. I will appeal for another ticket I was given last week that is as yet unpaid. I noticed the traffic warden entering my details so I rushed outside the shop to let him know it was my car.

Often they will say okay, and carry on their business. Sometimes they will be grumpy and walk off in a huff. A few have called into the shop to check it was my car.

This time it was too late, as my details had been recorded. I asked the traffic warden if I should move my car, but he said that it's okay now because I have a ticket. All this seems a bit ridiculous, this is why I'm appealing my ticket.

Because of the way the road is laid out, I am not preventing anyone with permits from parking. The road is empty bar one or two cars.
