Angry drakes, ccs: parking tickets not mine

Hi
wondering if you could advise as to whether i can claim back monies i have paid for parking tickets from bailiffs and councils as i did not commit the offences at the time. I was not the driver in all incidents as i was at work. I had borrowed my vehicle to a previous partner who accrued parking tickets and congestion charges whilst i was at work. i have paid over £7000 in tickets and bailiff charges for his misdemeanors. help!!!!!!!!

Sadly, if these are local authority tickets then it is you, if you are the owner who has responsibility for them. You may find that some of them were not compliant with the legislation and so you may be entitled to a refund but you will need to get true and complete copies of the tickets.

Any reason why you cannot go after your ex for the cash?

Before making any claim you must first request TRUE COPIES of all of the congestion charge notices. Only once you have these can you see if the tickets were legally able to be enforced as a result of the Landmark ruling in the High Court case of Barnet v Moses.

If the PCN's turn out to be non compliant, then because you have paid you cannot apply for a refund.....instead you must claim for restitution.

You must also send a Subject Access Request to each bailiff company for a complete breakdown of the fees and charges made on your account. Only once you have received the responses are you able to see where any overcharging may be.

Finally, if you did not receive any documents concerning these tickets...then you can apply for an "Out of Time" late Statutory Declaration form the Traffic Enforcement Centre. You can do this even if you have paid the PCN and bailiff charges.
