Default PCN advice please

Hi,

I was issued with a PCN for supposedly parking on a red route...I was not parked on the red route, but in a parking bay - my bumper might have been out of the bay, but my wheels were firmly inside the space.

I queried the warden who was issuing it, who then quickly slapped it on my windscreen and started a shouting at me, much to the amusement of passers by!

I have written to TfL requesting photos and laying a complaint about the behaviour of the warden, but they said they dont have any photos and are not required to give me any if they did. Surely, as I was on the 'red route' and these are monitored by cameras, through the Data Protection Act i should be able to get evidence. About the wardens behaviour they stated it never occured...huh?

I have just checked on line (seeing what the payment process is) and they have the colour of my car wrong, they say its white when its not..

The thing is, what can I do to demonstrate I wasnt on a red route, but in a parking space??

any advice would be great...

Are you sure you was in a parking space not a loading space as the offence on a red route for parking in one is the same as being on the red route itself I beleive?
Red routes are not all covered by cctv and are rarely enforced by them which is why tfl use police traffic wardens to do the job.
Photos are not a legal requirement to prove the contravention took place and lack of one is not a defence in itself.

Does the location on the PCN ( eg outside no.4 High st) match up with the place you were parked? You cannot get a parking permit for a Red Route do you mean blue badge or residents permit?

I have a residents parking permit, which allows you to park in the street in the parking bays...So it says 'university road sw19' (thats what it actually says) The red route is on the High Street, not on university road... thats why I am puzzled about the whole thing, and my car is not white, like they have on the ticket... thanks for your help green meanie

Park your car exactly where it was parked when you were issued with the PCN. Stick the PCN on the windscreen and take photographs from all sides of the car making sure you get the PCN stuck on the screen.

Keep the photos and challenge the PCN on the basis that the contravention did not occur.

The first 10-15 m of the roads running off Colliers wood high street are Red route. Your Merton parking permit is not valid on the bays near the junction. They are short term bays 20 mins I think maybe you overstayed or something without seeing the PCN or contravention code its hard to tell why you got a ticket.

hmmm...didnt realise that - as there is no signage to say it...will check again this eve...I just ran into the laptop shop to pick up my laptop...so was there for about 2 mins...

maybe I should just pay the fine and be done with it...although it irritates me highly!
