Default PLEASE HELP to cancel furniture order

im looking for some advice......I ordered a leather suite from SCS in july, and the sales man assured us we would have it delivered between 6-8 weeks and even wrote this on our receipt. Well we are past this now and the store advise us it could take at least another 4 weeks for us to expect delivery. We have in the meantime moved home and money has become very tight and this cash purchase we thought we could make now seems impossible, we are stretched to the limit now and are unable to pay the remainding monies owed for the suite. We have rang the store to cancel the order but was told that theres nothing they can do and they will take us to court if we dont pay the balance. We paid 10% deposit in cash and have offered for them to keep it but they are not interested. I understand this was made to order furniture but surely they can sell it on???
Is there anyone out there who can help us with this!!!!

IMO, when the salesman wrote 6 - 8 weeks on the deposit receipt, he made the delivery window binding on SCS. If effect, he made "time of the essence".

As they have failed to deliver within that window, I would write to them and point out that since they have failed to deliver within the contracted window, they have breached the contract and it is now therefore void. Furthermore, any attempt by them to take action via the Courts will be vigorously defended and that you require repayment of your deposit within 14 days or you will be issuing court proceedings.

In fact, they can't take you to court for the balance, even if the contract stood, as they have delivered nothing - they could only sue for loss of profit.

Hi

I have had dealing with SCS and found them to be very fair, they do ask you to sign a second document when ordering that does very clearly state that any delivery time is quoted as approx, while they do endeavour to make the delivery on time they consider that 4 weeks over as being reasonable. When mine ran over by five weeks I was offered a refund straight away by the store manager with a smile and he went out of his way to say how sorry he was.( keeping my order ) He even let me change the terms of the agreement and put it on 12 months credit. Why not try and talking to the Manager and ask if it is possible to put the suite on to a credit plan this way you would not lose your deposit and you would have the suite you wanted.
