Default Heart Internet

Morning all,

I currently have a dispute with an online web hosting company and am hoping I can get some advice.

Heart Internet

I had a resellers webhosting package at a cost of £38 per month. This was renewed on a monthly basis by the company debiting my card automatically.

Recently, I decided to stop the service and emailed Heart Internet to confirm this. On the day prior to renewal, I deleted all websites that were up as I had no intention of using it.

When deleting my payment details, I found that Heart Internet would not allow me to remove my account from file.

Subsequently, as the cancellation apparently takes 3 days (and you have to give 72 hours notice which admittedly I didn't do); they have charged £38 to my account for the next months fees.

When you log into Heart Internet, their system informs you that if payment is not made on time they may remove your services. Therefore I believed that by simply not paying, the account would terminate.

Now, the credit card that I had on file was very close to it's limit, therefore payment was rejected to Heart Internet. However, what they have done is repeatedly attempt to obtain payment by re-processing my details multiple times over a 4 day period.

They got payment once my card company received my monthly payment.

I have posted the relevant 'terms' below, I am asking if it would be possible for me to pursue a refund of my last payment.

To put it simply, I was not able to ensure they could not charge my account as they have 'forceably' retained my details.

Any prospect of success?

4.9 Should your chosen payment method fail Heart Internet will attempt to settle your invoice using any other payment facilities available on your account.
4.10 All services will renew until cancelled by the customer. Heart Internet emails the customers primary email address prior to renewal of services, it is the customers responsibility to cancel services prior to renewal as no refund can be made once renewal has occurred. Customers must notify us at least 72 hours before a service is renewed if they wish to cancel that service. The cancellation process must be fully completed by you before your account is cancelled.

not only that the reseller account doesnt cost £38 its £29.99

and not to mention I have the self same reseller account and whenever I raise a ticket to talk to someone ive had a reply in minutes, seems the OP relied on automated systems rather than actually trying to talk to someone
