Data Protection Act disclosure request

Dear Sir/Madam

Data Protection Act 1998 request for :

Mr XXXXX XXXXXX Account Number xxxx xxxx xxxx xxxx (Closed)

Please send me the information which I am entitled to access under Section 7(1) of the Data Protection Act 1998 (the ‘1998 Act’) in relation to all charges which you have applied to my above noted account within the last 6 years from the date of this letter.

Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my banking business with you. If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.

If you require any further information please let me know as soon as possible.

I enclose a cheque in favour of your bank in the sum of £10 with respect to the maximum statutory fee for processing this request.
Furthermore, if I discover that you have levied disproportionate penalties against me then I shall be reclaiming them and also reclaiming the enclosed £10 Data Protection Act disclosure fee.

I look forward to your response within the maximum 40-day time limit under the 1998 Act.

Hi and welcome to the forums.

Good to see you are on your way...

I don't think it can actually do you harm, but just be aware that you have left your full name on show in the post above.

If you wish to remove it, just click on the EDIT button at the bottom of the post.

Re: CharlieHo V Tesco Personal Finance

Data Protection Act request -statement received 12 05 06

Have looked through all statements - NO charges-which is correct as card was taken out whilst we had severe financial problems as interest free card. maxium advance initially went through payment plan with CCCS now paying £6.00 per week through collection agency with no charges or interest being add. They are one of the few creditors who did not accept a reduced payment in full & final settlement so continue to pay £6.00 per week (all I can afford ).
Had hoped there would be penalty charges to claim in order to settle card. Never mind others to be claimed against.

Request for statements under the Data Protection Act 1998
Thank you for your letter dated the 25th April 2006, enclosing a cheque for £10.00.

Please find enclosed copy statements, since the above account was opened, to date, which will detail any charges that may have been applied to your account.

With reference to your request concerning 'manual intervention' to any administrative charges debited, any charges would have been processed in accordance with the terms and conditions of our current agreement with you as a result of the activity on your account. In the event that you breach the terms and conditions, we will take the appropriate action, contacting customers when appropriate, or handling customer enquiries regarding their account status. When a customer has raised a concern in relation to this process, the matter will be investigated and the decision will be communicated to the customer and where appropriate noted on the account.

I trust the enclosed is of assistance to you.

Yours sincerely
Mrs M Carpenter
