Got a surprise this morning in the post, both £10 cheques were returned, with the following letter, could anyone please advise if this is acceptable, or am I being sold short.

Dear Mr M
Data Protection Act- Data Subject Access Request

Thank you for your request to access the information we hold about you, which is your right under the Data Protection Act 1998.
I note your request for a list of all charges applied to both current accounts on the above plan or alternatively a set of bank statements. Please note this is not classed as personnel information therefore,we are not required to provide this as part of the DSAR and ordinarily we would charge £5.00 per copy statement. I have however detailed below a summary of any charges, which have been appiled to both current accounts and the date of application. There is no charge for this service on this occasion therefore, please find enclosed the return of both your cheques for £10.

Hi,

i got this back from IF.

I wrote a letter back thanking them for doing this, but stating that although statements are not part of a DPAR, I actually asked for a list of ALL transactions and charges from my account.

Write something along the lines of the above and re-enclose the fee.

Remind them f the 40 days from the original request.

Don't worry about the manual intervention part, if it ever gets to court, you have tried but they have refused. It will not look good on them.

I hope this makes sense...
