Default Intelligent Finance

Hi all,

I'm about to send my initial request for refund to Intelligent Finance for £765.11 relating to an account which has been closed for a while. As some of you might know, IF is part of the HBOS group - my question is whether you guys think I should send the letter to IF in Livingstone, or Halifax plc at the address shown elsewhere on this forum - or indeed somewhere else entirely? I've not seen any other posts regarding IF, but hope they'll do the same as Halifax and refund (relatively) quickly!

EDIT(2): I see why it didn't turn it up - I searched on Wednesday, but only just got round to writing the letter! Should have searched again!

I'm going to try the 1 Baird Road, Livingston address and see what happens, as this isn't a Data Protection Act request...

OK, no reply to my initial letter (there's a surprise!). So I've just printed the final notice letter (which I've headed 'Notice of intention to begin court proceedings' - might as well use their own language back to them!) and will be posting it, first class recorded, tomorrow!

C'mon IF, I want my £765.11 back!

Default Interest on charges

Hi all,

I'm about to claim around £750 back from Intelligent Finance from charges levied a few years ago on what is now a closed account. However, about half of that amount is interest, charged at the Unauthorised Overdraft rate, and charged only on the Charges. Can I claim this back, as well as the 8% should it go to court?

I've read the FAQ, and it makes me think I can - but I wanted to double-check!

You can claim for everything on your statements that is not a justifiable service fee:

Claim:
  • Penalty Charges applied to your account. This is for exceeding overdrafts, referral/representation of DD’s and SO’s, cancellation of DD’s and SO’s, card misuse charges…the list is long!
  • Interest charged to your account for any of the above
  • When the interest is applied to the penalty charges, then this interest should be included
  • If your transaction history identifies what interest is applied for what reason, then be honest about the amount you request
  • If the interest is not itemised, then claim for ‘Interest Charges,’ and the onus will be on the bank to demonstrate the proportion they are entitled to

Don't Claim:
  • Agreed fees, such as £5 monthly overdraft arrangement fee
  • Any concept of costs or time at this time
  • Interest other than that which appears on your statements
  • Interest at 8% APR (that comes when you raise your claim at court)

Brilliant, thanks - that's what I thought, but I wanted to be sure before starting court action!

The LBA was delivered to them two weeks ago today, so I'll be filing a claim online if I don't get a response in tomorrow's post!

Right, still no satisfactory response, so going to file the claim at moneyclaim online - but they want an address in England or Wales, and Livingston is in Scotland!

Do you guys think it would be OK to register the claim against Halifax plc, at their Registered Office? After all, all the paperwork I've got from IF says "Intelligent Finance is a division of Halifax plc" and gives the Registered Office in Halifax.

yeah, go ahead and issue against the Halifax.

Put it this way, if you ate a bad mars bar you wouldn't issue against mars, you would issue against masterfoods.

It's just the way the bank dresses up it's products !
