Default Shop Direct And Lowell Financial *** WON ***

Hello again guys !

I think I might have WON something ! Not sure !

LOWELL FINANCIAL sent a letter received today stating,

"After liaising with Shop Direct in an effort to obtain this document we have been advised that it is no longer available due to the length of time since the account was opened with you"

"At this time we have closed our file and will not make any further contact with you concerning payment against this account unless the copy agreement is received at some point in the future from Shop Direct"

Now, both Shop Direct and Lowell have issued defaults against me !

How do I close this matter and remove the defaults against me as it appears they have been chasing me and adding penalties, issuing defaults on an account that is totally unenforceable !

Any ideas re letters ?!?! responses ?!?!?

Hi PtbG

Do you have all your stataments? If not, you should get them and start a claim for return of all the charges and rempval of the defaults. Eventually they will offer to settle and pay the charges back if you stick to the tried and trusted CAG method. However, do not settle unless the settlement includes default removal.

Hi Steven, sorry to sound ignorant but what is the best CAG method ? What letter should i send next ? I know what I need to say but its the wording and legal side that i'm unsure of ! Any ideas ?!?! oh and thanks for your help so far !

The method is:

1. send them a preliminary letter asking for the money back and give them 14 days to reply

2. send them an LBA giving them 14 days or else you will take them to court

3. take them to court

4. put up with loads of drivel from them before they settle before any court date

Letter from Lowell today states -

'we have noted your comments and can advise that all the relevant credit referencing agencies have been contacted to remove this incorrectly recorded default from your credit file. Please be advised this may take upto 28 days to show on your file'
