Got a letter from them this morning, not in response to any of mine, just a general letter regarding T&C's informing that they have decided to waive the £10 fee for customers requesting information.

I have only just sent my Subject Access Request so you are ahead of me but I'll keep you posted on developments.

I used to get my statements from Chatham,and thats also what showed up on my bank statements when I paid them.
I have done a rough calc of what I paid them over 18 months and its about 1500 quid. I seem to recall the card as only having a limit of 100 to begin with raising to 250.
I remember there being lots of 25 charges for going over then another 25 for something else (maybe late payment )
deadline for their Data Protection Act is 31/7 so they got time yet.

Their interest rate is horrifying, but any port in a storm I guess.

One of the other points in their letter to me this morning was that the purchase interest rate they are charging is going up by 4%, as if it were not high enough already!

I don't think 1 means you have a default. 1 just means you have missed one months payment. I think if the number is between 6-8 then it is a default. (I'm sure someone will be along soon to correct me if I am wrong)

Just got this from Vanquis this morning. I have the money so have paid but still, it’s damned annoying to read this stuff.

I would like to respond, is there a letter somewhere regarding this, particularly as I dispute the charges?




NOTICE OF INTENDED ACTION

Details of your arrears have been passed to our Legal Department for attention and they are now ready to serve you with a formal Notice of Default under the Consumer Credit Act 1974 for non-payment of your account.

It would be in your interest to pay all arrears immediately to avoid further action being taken against you.

If you did not comply with the terms of the Notice of Default, we would be entitled to terminate your agreement and take legal proceedings to recover the full amount of your outstanding balance. Theses actions could include:

- passing your account to a Debt Collection Agency to collect the full balance on our behalf
and
- Starting legal action to recover the balance, either by payments to the court, by your employer deducting the money from your salary, or by taking a charge over any property you own. This may involve a bailiff visiting your home to recover goods.

You would be required to pay the costs of this legal action and a County Court Judgement may be placed on your Credit File for other lenders to see. Current or prospective employers will/can also have access to this information.

I am sure you do not want this to happen; to stop any further legal action being taken against you, you only need to pay the arrears amount now. Please take up this final offer of assistance and contact me today.

Now I have paid, but not because I feel threatened, I have spent money on the card and I should pay that back. But I would like to respond with something here because I feel that this letter contains phrases intended to intimidate and bully and that is not right.

Any one got any ideas, particularly as I already sent my Subject Access Request letter to this lot and technically the account is in dispute. Although I am not over the limit, even without this payment today, I have been charged punitive late payment fees.

Statements recd today.

Not been thru them yet.

Also man intervened notes.They have actually handwritten the explanations for the various codes...how good of them.
No signs of any copy of the default letter or deed of assignment.
