in reply to their letter I sent an e mail which was delivered.
I stated that their requests were illegal and unenforceable.
I told them I was challenging the debt with the RBS
I also informed them that I would be submitting a Data Protection Act request and also a request to see the original agreement.
In addition I stated that I believed their default to be wrong and unjust.
I sent the letter off.
This morning I got another saying they had not rec my reply and were giving 7 days before legal action.
The amount they are trying to recover is 630.00
Today I got my bank statements and the total charges are a staggering £2360 for which every penny is a penalty !!!
I will be calling them to ask them to go ahead with their actions.................. .
One thing I am interested in......if the bank (as they have been doing ) pay back the penalty charges effectively wiping out the debt then presumably they have to repay the dca the money that they paid for the debt ??
does this mean we will also see dcas issuing proceedings against the banks ??
