| | Gold Account Customer | Me V's another one! ***SETTLED IN FULL*** Hi peeps, am near the end (hopefully) of taking on Lloyds, and in the middle of it with Halifax for my mum, and have decided to take on Capital One. I have started this thread to help me keep track of things, especially as I now have 3 ongoing 'battles'
Sent off the Subject Access Request just over a week ago, had a letter yetserday saying Thank you for your recent letter in which you requested copies of all of the statements on your account, blah blah blah, I will send them to you when I get them, from Katherine Blunt. Now it's a case of wait and see.
A year ago I had my card on a payment plan, and as soon as I got within my credit limit again they gave me my card back!! Don't think the charges will add up to more that a couple of hundred, but it's MY couple of hundred and I want it back!  |

| | Gold Account Customer | Re: Me V's another one! Well, statements arrived today, I had to sign for them. The envelope was battered but not torn anywhere. Quick calculation tots it up to £562!!  I really didn't expect it to be that much. In my letter it states that my statements for Mar 04, Feb and Sept 05 will be forwarded onto me as soon as soon as the archiving dept obtains them. They also went on quite a bit on how my data is used, how they obtain and process data blah blah blah...
So, I will take the next step, request my money back....hope they are easier than Lloyds..... |

Recieved a reply from them today, as well as the usual sorry you are not happy but you agreed to pay these blah blah blah, they have offered me the 'difference' between the OFT's £12 and their charge of £20 as final settlement. I will, of course, only accept it as part payment.
the letter also states: You also asked me to remove the default notice from your credit file. ( no, I didn't!!) We have to record accurate information with credit reference agencies, including late payments and defaults. Your account hasn't defaulted so there isn't a default notice on your credit file. (I knew that, thats why I didn't ask for a default removal!)
They have obviously sent me a template, no surprise there then  |

Great info too, as I have no knowledge of Cap1 myself, and I'm doing a claim for my friend Ana, and she just got the template as you describe above about default removal, so that's great to have your case to refer to in terms of timescales. Fantastic!!!!  |

This site is invaluable with the amount of information and help available, and I would like to take this opportunity to encourage others to donate, they wouldn't get their money back otherwise, it's worth every penny!!!
BW, I would say that compared to Lloyds, Cap 1 are easy and Ana should get her money back relatively quickly  |

| | Gold Account Customer | Re: Me V's another one! ***SETTLED IN FULL*** I have received cap 1's defence today, along with a N150. They are defending saying they have paid me in full. Well as I've not received the cheque yet they haven't exactly paid me in full have they?
I will send them a letter stating I will let the court know it is settled as soon as I have the cleared funds in my account. Do you think it would be a good idea to send the court a copy of the letter too, so they know whats going on?
There was also a 'Court mediation Services' form in with the AQ, haven't seen one of them before.
How's Ana's claim going BW? |
