Default Zoot v Halifax 1st Mortgage + 2nd Mortgage **WON**

Yes I was very greedy and had not 1 but 2 mortgages with the Halifax!

They are both closed now so I thought it was safe for me to pursue a claim for charges.

S.A.R - (Subject Access Request) sent 29.6.06
Received 20.7.06

Received a letter 2 days earlier stating I had to collect S.A.R - (Subject Access Request) from local branch and take id as we had changed address since redeeming. letter contained the standard comments of not having to provide detail of manual intervention (although some was included).

Statements were very difficult to follow all codes and no reasons given for the charges.

I was rather surprised in calculating the charges in my first mortgage- thought there would be loads - but only 45.00? Despite being four months in arrears at time of redemption. Also there was loads of manual intervention- thought I'd better shelve the idea of making a claim - even thought perhaps I ought to offer them a little more... but then came to my senses

Regarding the second mortgage charges amounted to 270. This was made up of 8 charges of 10.00, 8 of 20 and one of 30.00. Pretty surprised to see the 10.00 charges as I don't remember being charged 10.00 and also it will perhaps make it a little more tricky to claim. However, on reflection I will include them and if they query shall just ask them to prove their costs.

Will await the outcome of my other claim for redemption fees before commencing this one.

Keep you posted.

Well if they had anything about them they would already know about your previously successful claim and put a cheque in the post immediately on contact, hmm guess not then, good luck.

Zoot, I have massive correspondence with Holyfax and am about to issue LBA. Any response yet? Was your mortgage taken out with Holyfax or one of the companies it took over?

Hi Tideturner,

Not had a single piece of response in relation to this claim other than the acknowledgement of service. I had one letter in response to my first claim which they have now settled. Both taken out with the Halifax.

Best of luck with yours

Letter received today, they are going to refund in full including interests & costs.

In the usual scheme of events with Halifax administration they claim they are going to refund it to my account ... hello this was a loan which was settled in February! ... also they gave some helpful hints as to how I can avoid incurring these fees in the future and keep track of my account by phoning their advisers at anytime!

Oh well had better advise them a cheque will do nicely!

Thanks very much Halifax!

Obviously you will accept their offer on the provisor a cheque is received within 7 days?
Get on the phone tomorrow - tell them the mistake and insist a cheque is sent out first class!
