Hello,
we're currently claiming £1500 back. waiting for defence from corbetts BUT in last week NatWest has charged us another £300! we cant pay our gas/water/electric bills because of this and im just SO angry!! it could be another 6 weeks till we get that money back which means in Nov we will probably incurr another load of charges sinking us even deeper into trouble! my husband phoned to moan about this but guy on phone didnt help at all!
Do you think i should write a letter of complaint to the bishopsgate address?? i mean this is actually started to sink my husband into a bad depression as hes working 60 hours (night shifts)a week to try and keep on top of this and they are taking alot of the money purely on charges. last month it was about £240. its just getting worse.. if i write and say about its affecting our health /and we actually are going hungry ourselves just to make sure the kids are getting fed because we have no money for food/living etc do you think they may refund some/ all of this £300 or because we currently have an ongoing thing at the mo will completely ignore it. im not just making it sound bad, im actually getting quite worried about my husband as he suffers with quite bad depression anyway. he got paid today and straightaway £400 was deducted to cover all the charges that has made us so overdrawn. we do have debts but we were just about managing until one month we got charged, then it spiralled from there! sorry to moan just any advice would be appreciated. im losing sleep!

you can send an amended/updated schedule of charges to the court.

if the charges are for dd refusal, just cancel them for the meantime

hiya, thanks for reply! can i add on more charges? even if acknowlegment has already been done by corbetts?? i added on septembers before i did mcol. but now thats done i thought there wasnt a possiblility of adding anymore on?

You cannot amend a claim merely by sending the court an updated schedule of charges.

You would have to submit an application N244 + £35 fee to amend the claim .

hiya

We were in exactly the same position where NatWest has taken of us £2500 in the last three months and we were sinking.
My better half went and saw the manager and informed him of our first right of appropriation - if you don't know, this is a legal right you have over your money. If you inform your bank of this they can not use your money to cover their charges until you have paid your bills etc. Your local CAB can give you more ino on this if you ask them. Make sure though you put it in writing and recorded delivery or reciept.
Our manager said tough they will do what they want with our money and you will have to take us to court. So we are.
We could not attach it to our existing claim as we are up to £5,000 already so -
We made sure we had cheque books and guantee cards, emptied our accounts and have opened new ones elsewhere and have our pay paid directly into the new one. Cancelled everything on the NatWest account and then paid all our bills up to date by using Natwest cheques equal to the amount that the Natwest have taken from us since we started our claim, this included writing some cheques to ourselves so we could survive until we get paid again.
We have writen an extended version of the request for payment letter asking for them to close the account as settled or we will make a further claim against them.
Even if they dont pay up, it is them that have to wait for the process, not me. They will pay for it, not me. I will recieve the interest at contractual rate if they refuse and make me issue a second claim, but most importantly we can now survive and have a chance of getting through this still owning our house and being able to feed our kids.
Some people may not approve but we were seriously at risk of losing everything due to the NatWest.

Similar place, me!
been told to give back cheque book & card, frightened to use it now in case they charge me with some sort of theft. £550 overdrawn over 2 accounts, £700 charges in 5 weeks. I should be in credit if they weren't such tight, greedy little people! (thats the bosses, not the staff.)

Hi all,

The bank have to honour the cheques if the cheque quarentee card number has been put on the back as long as it is for less then the maximum of the card.

With regards to the rights and wrongs of it - I can not see that you can get into trouble if you use the facilities that the bank have knowingly given you, especially when they know your situation.
We have given the bank every opportunity to stop breaking the law and it is only as a consequence of them doing so that I used the money that should have been in my account - because i gave them my first right of appropriation i could do this without breaking any laws and to support me further i immediately entered into a legal dispute over the amount that my account is now overdrawn so they can not persue this matter legally also. If they do then again they will be breaching common laws.
Professionally - i can say that if i had this case brought to my attention then i would be happy that it is a civil dispute and not a criminal matter. Therefore i would not persue or investigate and allegations made by either party.
It is only my opinion and was in my best interest at the time as we would not have survived the wait of process for our first claim. Also by the time our first claim would have been settled we would have owed it all out due to NatWest charges. This has just enabled us to survive.
As we were told by a Manager from NatWest "now we have your money TOUGH we will not help you, if you owed us then we would be more willing to assist in sorting these matters out".
We now owe them so lets see if they stick to their word. If not then they can wait for their money.
