| | Basic Account Customer | *Mods Check please!* Getting the rest of my money. After winning, I've been fined again for the value of about £200.
I want this money back quickly and without the cr*p I/we have to go through.
I haven't responded to the letter the RBS have sent me with my cheque in it.
I've knocked this letter up and am about to send it off. Could someone with a bit more experience check this and tell me what they think? Quote:
(My address and claim number)
Dear Sir/Madam, Please note this is not a generic/template letter.
I am pleased that you have decided to settle my above claim in full. And as per your request, I have now started to discontinue my proceedings against your bank.
I am impressed at the professional way you dealt with my claim, it was resolved professionally, politely and quickly.
However,
In the last month alone you have managed to charge me £xxx in bank fees, which as you already know, I believe to be unlawful.
(I now understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations.
I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.)
I do not wish to have to start another court case against you, as it is time consuming and costly for both parties, however;
I require repayment in full of this money. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice.
When I have received this repayment, I am willing to close my NatWest bank account if you deem that to be necessary, but be confident in the fact, that I will pursue this vigorously.
I hope we can come to a quick, mature agreement before the 14 days limit expires.
Regards, Bazzlad |
