BUT - as you do have cobbetts as solicitors and love pretending theres a lack of particulars in this MCOL wording why not consider using the N`1 form and sending your schedule of charges and letters with it? see links below. It costs the same. |

Any more advice would be greatly appreciated.

| | Basic Account Customer | Re: Urgent Help Required Is this the thread you were both talking about: I, the claimant, MrXYZ, have an account, number 000000-00000000, with the defendant which was opened on 21.05.2002. I am claiming the return of money taken by the defendant in the way of charges over the last 4.5 years plus the interest they have levied on those charges. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999, Para.8 and sch.2(1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982, s.15. I have requested the defendant justify their charges but they have failed to do so. The suns claimed are: a.charges of £xxxx, b.overdraft interest of£xxx.xx, c. court fee of £120, d. interest under section69 of the County Courts Act 1984 of £xxx.xx plus £0.xx per day up to day of judgement. |
