Wink Paypal, NatWest and the Direct Debit Guarentee ???

Hi there

I hope I have posted this to the right section. I couldnt find one that deals specifically with Paypal and or the direct debit guarentee. So sorry and hello in the first paragraph.

My problem is really quite long winded with regards to paypal, but it has now taken a slant towards advise with the direct debit guarentee.

on the 21st of this month Paypal took nearly £500 from my main account with NatWest a step account. They did this as my account was nearly £500 overdrawn but this is the bit of the long winded story .... the financial ombudsmen are helping/investigating this for me as they allowed somebody to pay with a fraudulant card etc etc the long and short of it was my account was under review by paypal and the financial ombusman were watching over them.

My initial response was surely I was covered by the direct debit guarentee/indemnity I called up and there initial response was yes I would be, they had to pass it through to their care team but yes I am covered under the guarentee.

They had not notified me that they were going to do this, they didnt send me a recipt which they normally do. I only found out they had done it when I couldnt use my card at the shops.
I was left with £1 for over Xmas thank goodness I have friends.

Yestreday Monday I had a call from NatWest and they said they cannot put the money straight back in my account which they could normally do if there is a dispute like this as Paypal is an american company and they play by different rules?

Does anybody know if that is it with help and recompense from my bank?
They say paypal UK so surely they must be goverened by our rules if they set up direct debits.

Any help would be appreciated

Your bank are talking rubbish. Firstly Paypal (Europe) S.à r.l. & Cie, S.C.A.are in Luxemburg (which is a full member of the EU), and they are also regulated as a bank by Commission de Surveillance du Secteur Financier (CSSF), which is a sort of equivalent to our FSA.

Secondly, where Paypal operate from is completely irrelevant. The Direct Debit guarantee is as follows:

This Guarantee is offered by all Banks and Building Societies that take part in the Direct Debit Scheme.
The efficiency and security of the Scheme is monitored and protected by your own Bank or Building Society.
If the amounts to be paid or the payment dates change XXXX will notify you 10 working days in advance of your account being debited or as otherwise agreed.
If an error is made by XXXX or your Bank or Building Society, you are guaranteed a full and immediate refund
You can cancel a Direct Debit at any time by writing to your Bank or Building Society.
As you can see, there are no "if"s or "but"s - it is very clear what your rights are. Contact your bank again and demand they make a full and immediate refund, as promised in the DD Guarantee.

Been in to my bank today and they reiterated what I was told over the phone. Paypal arnt signed up to thge direct debit indemnity

Paypal don't have to be. The DD guarantee is something offered by your (and all) bank(s).

Personally I'd suggest treating this similar to a charges claim and send NatWest a prelim followed by an LBA and if they still not playing ball file a claim

Absolutely, read the first part of the DD guarantee I quoted:

It's protection offered by your bank, not the retailer. If it was down to the retailer then the guarantee would be pretty pointless to be honest. Your bank are seriously messing you about with this, you could write a letter as suggested earlier, but in this case I think you want to ensure the refund is made immediately so before you do that, perhaps worth one last try to speak to your bank. Speak to a manager. If you visit your bank take a copy of the DD guarantee with you (it's attached to every DD mandate so just find any form with a DD section on it).

Your bank that accepts DD is goverend by the dd guarantee.

have a whisky and get back to your back and demand the indemnity be placed.
