In the light of the recent statement by Graham Beale acknowledging that Nationwide's penalties are unfair and indicating that they are profit-making, it now seems clear that even on Nationwide's own admission the charges are unlawfully imposed upon their customers.

This would be shocking news had we not all known this already.

If you have been defaulted as a result of unlawfully imposed penalty charges then we suggest that you take immediate steps to have your default removed by court action.

Post a thread in this forum and we will help you of course - as usual.

It will probably cost you £150 outlay in court fees but you will get this back when you win.

Beale's important statement makes it extremely likely that you will win.

If necessary we will help you get him into court to explain precisely what he meant.

Additionally, if you have been damaged by your default then there is a possiblity of damages in defamation.

Hi Bankfodder

I have been defaulted on two accounts by Alliance & Leicester, virtually all amounts that led to the defaults were masde up of penalty charges. I would like to clear the defaults if I can. I have already posted to them letters asking for a refund of these charges and now have my bank account elsewhere. I am more than happy to go for the £150 to take them to court. How do I start though?

Yesterday I issued a claim against Nationwide via MCOL for £650 plus costs as they have refused my earlier written claim and stating in their reply that they are open and transparent about their charges and that if I that I feel that I am not able to abide by the terms and conditions of the account then it may be appropriate for me to consider alternative banking arrangements.

I assume from this that when they receive my claim they will close my account but as long as it get my £650 plus interest and courts costs refunded then I will happily move banks.

They seem to have forgotten that earlier this year they thought it was inappropriate for them to pay a £900000 fine and that it should be paid by the members of the society ie US.

Its great to hear that Nationwide seem to be admiting charging unlawfully, however, I submitted a claim via MCOL on the 12 March, but still have not seen hide or hair of a penny! Do you think they're making me sweat?

Hi Bankfodder

I have been defaulted by nationwide on a joint account with my wife.

All of the monies they claim we owe are for boumced DD plus unauthorised overdraft fees, the over draft only being caused by the bounced DD, priceless.

They have passed this to a debt collecting agency, Moorcroft Debt Recovery.

Should I just let them take me to court and ask them in the court hearing to justify their charges?

Seems like it might be the only way to get the blighters to make a court appearance.

BTW I have started a thread on this.

As the claim was submitted on the 12th March they have 14 days from when it is recieved by them to respond.MCOL state that once the claim is validated by the court you need to allow 5 days for it to be received by the defendant-so in your case it was probably not received by Nationwide until the 19th so they will have 14 days from then to reply to you.

Unfortunately it is a bit of a waiting game but from what I had read elsewhere in CAG there is every chance that you will get the charges,costs and interest repaid to you.
