Default Final Response Letter

Hi

Hope you can help.

Nationwide sent me a final response letter and told me to go to the Ombudsman.

They informed me that debt recovery would still continue to chase money owed on my overdraft - which they called in - and they have closed one of my accounts (which they had already frozen) and taken the money to clear the debt which includes the charges I was contesting. I thought they could not interfere with accounts whilst in dispute. Am I right or wrong?

Any assistance or experiences welcomed. I am very upset and distressed by these latest actions and could do with some advice. Thanks.

Unfortunately they can close your sacount and ask for the return of overdrafts although i thought thry had to give 28 days notice of intention to close, maybe someone else can clarify, if they are not paying back the charges after sending the S.A.R - (Subject Access Request) then go straight to court and file.

Ali, I'm not sure about your first query, I hope somebody will help shortly on that.
However, you cannot go straight to court action after only the S.A.R.
That is only asking for your information.
Only when you have had a negative response to the preliminary letter and the letter before action, and waited 14 days after each can you file a claim.
This because you have to demonstrate to the court that you have seriously attempted to negotiate a settlement with the bank before court action.
Let us know how far you have got, and what letters you have sent and we will try to help.
