Default Can i take advantage of your knowledge??

I am about to put in a claim to Nationwide. I have a question that i would love some help with. I used to have a Flexaccount from 1995 to 1999. Unfortunately i got sick in 1998 and my account dive bombed into despair. I was overdrawn and charges were added quicker than i could blink. I was threated with legal action so took out a personal loan to repay the current account in full and close it down. I then opened another Flexaccount a few years back. This is the account i will be claiming for. I just wondered if i would be able to put in a claim for the old account. If it wasn't for the old account, i wouldn't have ended up with a terrible loan and financial ruin almost because of it. My credit rating is still suffering from the backlash and it all stems from my Flexaccount problems in 1998. Any advice would be gratefully received. Many thanks and enjoy the rest of the weekend

I'm afraid as its longer than six years ago you cant claim for the old account, sorry!

I thought there was a good case for arguing that the Statute of Limitations didn't apply to bank penalty charges, and that claims CAN be made on charges over 6 years old.
...or have I missed a Test Case ruling ??
There's a thread on this here, somewhere, I'm sure.

Aah - found it !!

Proving the banks knew the charges were unlawful- thereby negating The Limitation Act

It's a bit of a messy thread, as it got confused with another for some reason. That may be why you missed it, CB.
